AN ORDINANCE VACATING THE SIDEWALK AND
UTILITY EASEMENT LOCATED WITHIN LOT 5, BLOCK 1,
HISTORIC ARKANSAS RIVERWALK PROJECT, FILING
NO. ONE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described sidewalk and utility easement:
THE SIDEWALK AND UTILITY EASEMENT IN LOT 5, HISTORIC
ARKANSAS RIVERWALK PROJECT, FILING ONE, ACCORDING TO
THE RECORDED PLAT THEREOF AS FILED FOR RECORD AT
RECEPTION NO. 1289663 IN THE PUEBLO COUNTY RECORDS
is hereby vacated.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval.

WITHIN LOT 5, BLOCK 1, HISTORIC ARKANSAS RIVERWALK PROJECT, FILING

ISSUE
Should City Council approve the proposed vacation of the sidewalk and utility easement
located within Lot 5, Block 1, Historic Arkansas Riverwalk Project, Filing No. One?
RECOMMENDATION
The Planning and Zoning Commission, at their February 8, 2012 Regular Meeting,
voted 6-0 to recommend approval.
BACKGROUND
The Historic Arkansas Riverwalk Project, Filing No. One was platted in July 1999. At
the time, the right-of-way was insufficient to provide the space necessary for appropriate
handicap ramps and several utilities were located across this portion of the site. Due to
the current construction of the addition to Memorial Hall, the utilities will be relocated out
of the easement. In addition, the streetscape along Grand Avenue, as well as the
Grand Avenue and Main Street intersection, will be reconstructed and will allow for the
installation of the handicap ramps within the street right-of-way. Once these two
reconstruction projects are complete, the easements are no longer necessary.
