A RESOLUTION APPROVING AN AGREEMENT FOR
PROFESSIONAL ENGINEERING SERVICES BETWEEN
THE CITY OF PUEBLO, A MUNICIPAL CORPORATION,
AND JR ENGINEERING IN THE AMOUNT OF $39,860
RELATED TO PROJECT NO. 11-101 (PL0804), STE M086-
053, (16810), 1ST STREET & SANTA FE AVENUE
STREETSCAPE AND AUTHORIZING THE PRESIDENT OF
THE CITY COUNCIL TO EXECUTE SAME
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Agreement for Professional Engineering Services by and between the City of
Pueblo, a Municipal Corporation, and JR Engineering relating to Project No.11-101

(PL0804), STE M086-053, (16810), 1 Street & Santa Fe Avenue Streetscape, a true
copy of which is attached hereto, after having been approved as to form by the City
Attorney, is hereby approved.
SECTION 2.
The President of City Council is hereby authorized to execute the Agreement on
behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix the Seal of the
City thereto and attest same.
SECTION 3.
Funds in the amount of $39,860 shall be expended from Project No. 11-101

Should the City Council approve an agreement with JR Engineering, Inc. for

RECOMMENDATION
Approval of Resolution.
BACKGROUND
The City of Pueblo received a Transportation Enhancement Grant for streetscape
st
improvements at the intersection of 1 Street and Santa Fe Avenue. In general, the
project involves the design of roadway and streetscape improvements at the
st
intersection of Santa Fe Avenue and 1 Street; north to 2nd Street and south to Hector
Garcia Place, to include curb & gutter, urban storm drainage, sidewalks, storm drainage
inlets, traffic signals, decorative paving, landscaping, gateway feature amenities,
pedestrian lighting and enhanced pedestrian crossings.
FINANCIAL IMPACT
Funds in the amount of $39,860 shall be expended from Project No.11-101 (PL0804),

THIRD AMENDMENT TO
AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES
This Third amendment to Agreement for Professional Engineering Services ("Third
Amendment") is executed to be effective as ofJanuary 21,2020 by and between the City of Pueblo,
Colorado, a Colorado municipal corporation ("Owner") and JR Engineering, LLC a professional
engineering firm and Colorado limited liability company ("Engineer").
WHEREAS, Owner and Engineer entered into that certain agreement for professional
engineering services dated February 27, 2012 (the "Agreement"); and
WHEREAS, Owner and Engineer entered into a First Amendment to the Agreement dated
February 1 1, 2019. Nunc pro tunc effective February 10, 2017 ("First Amendment"); and
WHEREAS, Owner and Engineer entered into a Second Amendment to the Agreement
dated February 25, 2019. ("Second Amendment"); and
WHEREAS, Owner and Engineer desire to modify the Agreement, the First Amendment,
the Second Amendment and Third Amendment pursuant to the provisions set forth herein.
NOW, THEREFORE, in consideration of the foregoing premises, the mutual promises set
forth herein and other good and valuable consideration, the receipt and adequacy of which is
hereby acknowledged, Owner and Engineer hereby agree to the following:
AGREEMENT
1. Scope of Services and Cost of Services. Engineer shall render certain engineering
and related services for Owner in connection with City Project No. 11-101, STE M086-053
(16810) 1st Street and Santa Fe Avenue Streetscape, in accordance with Amendment #3, dated
January 15, 2020 attached hereto and incorporated herein by this reference.
2. Successors and Assigns. This Third Amendment shall be binding upon and inure to
the benefit of the parties hereto and their respective successors and assigns.
3. Ratification. Except as expressly stated herein the Agreement, the First
Amendment and the Second Amendment shall remain in full force and effect. If there is any
conflict between the Agreement, or the First Amendment and the Second Amendment and the
terms of this Third Amendment, the terms of this Third Amendment shall control.
4. Counterparts. This Third Amendment may be executed in one or more
counterparts, each of which shall be deemed an original and all of which shall constitute one and
the same document with the same effect as if all parties had signed the same original. The parties
further agree that transmission of this Third Amendment by telecopy or via email in a PDF format
shall be deemed transmission of the original Third Amendment for all purposes.

Amendment#3 to Agreement Dated February 27, 2012 for Project 11-101
Dear Mr.Zwick:
appreciates the opportunity to provide you this amendment for additional services
related to the City Center Drive and Santa Fe Avenue Streetscape project. Based on previous meetings and
discussions with the City of Pueblo (the City), plans to utilize the following Scope of Services to help the
City of Pueblo successfully complete construction of the project:
BIDDING PHASE:
During the bidding process, provided the following services:
o attended the pre-bid meeting;
o attended one progress meeting with the City;
o attended phone conferences with the City;
o - addressed City comments on the plans and specifications; and
o answered bidder questions, provided clarifications to plans and specifications, and
assisted with preparation of addendums.
These tasks were already completed, and is requesting authorization from the City to send an invoice
for the work.
will also assist the City with updating and plans and quantities for re-bidding the project. The updates
will be based on the City's red lines from 1/10/2020.
CONSTRUCTION ADMINISTRATION:
'_. will assist the City during the construction phase of the City Center Drive and Santa Fe
Avenue Streetscape project. Specific services to be performed by are as follows:
Pre-Construction Meetings: personnel will attend the pre-construction meeting with the Contractor,
surveyor, and the geotechnical engineer for this project. The pre-construction meeting shall include
discussion of the following:
Clarification of any items in the plans or specifications;
Exchange names and phone numbers of contact personnel;
Request and review the construction schedule provided by the Contractor;
Request and review all work safety and construction traffic control plans;
Establish a process for requesting information and responding to such requests; and
Any other special construction conditions will be clarified.

Construction Progress Meetings: personnel will attend two (2) progress meetings with the Contractor,
geotechnical engineer, and the surveyor. These meetings shall address:
➢ Project Coordination;
• Construction issues that need to be resolved;
i► Work completed since the last meeting;
✓ Problems encountered and recommended solutions;
✓ Review of alternatives;
fr Anticipated delays and late activities;
i- Activities required by the next progress meeting; and
r Discuss and update the schedule and revise as necessary.
Shop Drawing Review/Respond to RFI's: personnel will review any necessary shop drawings, material
submittals, or traffic control plans submitted by the contractor for general compliance with the design
concept. 1,- will also coordinate with applicable parties (City of Pueblo, CDOT, utilities, and designers) and
prepare a written response to the Contractor's Request for Information. We will maintain a shop drawing
and RFI log during construction.
Construction Observation: will visit the project at appropriate intervals to observe the progress of the
work and inspect the work for general conformance to the construction documents. will also give
opinions and suggestions for resolutions based on the observations regarding defects or deficiencies in the
Contractor's work and with compliance with the drawings, specifications, and design concepts. Assumed
four(4)site visits at three(3) hours per visit.
Construction Design and Field Change Notices: shall serve as liaison between the City and the
Contractor in providing interpretation of the construction documents, transmitting clarifications and
resolving field conflicts. As needed, ;i personnel will prepare and issue Design Change Notices or Field
Change Notices during construction. We will also maintain an updated plan set at all times.
OPTIONAL SERVICES:

this proposal.
Pay Request Review: personnel will review and approve pay requests forwarded from the Contractor.
P will forward the application for payment along with a recommendation for approval to the City. i. ,
review shall be for the purpose of providing a general review of the payment request. can also review
and verify the quantities of work performed during the pay request period.
Change Order Request Review: can provide documentation and administer the processing of change
orders, including change orders for extension of construction time. Evaluate the cost and scheduling
aspects of all change orders and, where necessary, negotiate with the Contractor to obtain a fair price for
the work. Said negotiation shall be subject to the approval of the City.
Review of Reports,Cut Sheets,and Tests: can receive certifications of material compliance,field tests,
daily construction reports, survey cut sheets and approvals. We will review the QA/QC documentation
reports for general conformance with applicable specifications and transmit them to the City of Pueblo.
can also prepare and distribute monthly progress reports to the City of the general construction progress.
REIMBURSABLE EXPENSES:
has estimated within this proposal an estimated budget for Reimbursable Expenses, which includes
reproduction of plans, vehicle mileage, and miscellaneous delivery costs. These expenses will be
reimbursed on a time and materials basis and the client will be notified prior to the estimated budget

being exceeded.
COST OF SERVICES:
!, f.f _,__£ will perform the work scope described herein for a time and materials not to exceed fee of
$14,040. The project will be billed as time and materials not to exceed cost. A Fee Schedule and Resource
Allocation chart has been included that provide more detail of the man hour break-down for each
individual task.
