ORDINANCE NO. 8424
AN ORDINANCE VACATING THE SOUTH TEN FEET OF THE
ALLEY LOCATED WITHIN BLOCK 9, WESTVIEW
RESUBDIVISION
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described alley:
A 10 -foot wide strip of land situated in Leach's Westview Subdivision in the City
of Pueblo, Pueblo County, State of Colorado, more particularly described as
follows:
Beginning at the northwest corner of Block 9, said northwest corner being
situated on the east right of way line of Prairie Avenue, as said Prairie Avenue is
shown on the abovementioned Plat of Leach's Westview Subdivision, said plat
being on record in the Office of the Pueblo County Clerk and Recorder under
Reception Number 660688, thence along the following courses:
North 88 55' 28" East a distance of 58.66 feet along the north line of said Block
9; thence continuing along said north line of Block 9 South 46 03' 32" East a
distance of 132.35 feet to the easternmost corner of said Block 9 situated on the
northwest right of way line of Airport Avenue, as said Airport Avenue is shown
that abovementioned plat of Leach's Westview Subdivision; thence North 43 56'
28" East a distance of 10.00 feet along the extension of said Airport Avenue;
thence parallel to the abovementioned north line of Block 9 North 46 03' 32"
West a distance of 136.49 feet; thence South 88 55' 28" West a distance of
62.80 feet to the extension of the abovementioned east line of Prairie Avenue;
thence along said extension of the east line of Prairie Avenue South 01 00' 36"
East a distance of 10.00 feet to the Point of Beginning;
Said strip of land containing 0.054 acres, more or less.
is hereby vacated, reserving however to the City of Pueblo and the public the entire 10 feet
thereof for a pedestrian and vehicular access way.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and approval.

ISSUE
Should City Council approve the proposed vacation of the south ten feet of alley located
within Block 9, Westview Resubdivision?
RECOMMENDATION
The Planning and Zoning Commission, at their November 9, 2011 Regular Meeting,
voted 4-0-1 to recommend approval.
BACKGROUND
The purpose of the vacation is for Oscar’s Liquor to construct an addition to the east of
the building, necessitating the relocation of the drive-thru window. By locating the drive-
thru along the alley, the applicant frees up much of the property for parking and building
addition. Relocating the drive-thru also allows for a greater amount of vehicle stacking
along the alley, with the excess (if any) spilling out onto Airport Avenue (shown on maps
as Kenwood Drive), rather than Prairie Avenue, as it exists currently. The alley is used
by the liquor store for their trash dumpster and overhead utilities. Of the three (3)
residential properties to the north, only one has gated access from the alley. The
access will be maintained to these properties with the reservation of 10 feet of the alley,
as well as, the public access way on the vacated portion of the alley.
