HomeMy WebLinkAbout03983 i 7 13 ORDINANCE NO 3983 AN ORDINANCE AMENDING CHAPTER 4, TITLE XVII OF THE 1971 CODE OF ORDINANCES OF THE CITY OF PUEBLO TO ESTABLISH A NEIGHBORHOOD OFFICE ZONE DISTRICT, 0 -1 BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that (Brackets indicate material to be deleted; underscoring indicates new material to be added ) SECTION 1 Section 3 of Chapter 4, Title XVII of the 1971 Code of Or- dinances of Pueblo, Colorado is hereby amended to read as follows "SCHEDULE OF DISTRICT REGULATIONS 0 -1 B -1 B -2 B -3 B -4 (a) Min Lot Area 5,000sf 5,000sf 5,000sf 5,000sf 5,000sf (b) Min Lot Width 50' 50' 50' 50' 50' (c) Max Coverage 50% 50% 50% 50% 100% of Lot (d) Max Floor Area 5 -- -- 1 5 4 Ratio (e) Max Building 20' 35' 35' 50' -- Height (f) Min Front Yard (D) (D) Setback 25' 25' 25' 25' -- (g) Min Side Yard (A) (A) (A) (E) (A) (F) Setback 5' 5' 5' 15' 5' (h) Min Rear Yard (A) (A) (A) (E) (A) (F) Setback 15' 15' 15' 15' 15' (A) Does not apply on the portion of the par- cel adjacent to another parcel also in a Business or Industrial zone It does ap- ply when the portion of the parcel is ad- jacent to a residential or special zone (streets or alleys not considered) (B) See Section 17 -4 -5 and Section 17 -4 -6 for additional requirements (C) See Section 17- 4- 51(17)(c) (D) That portion of the parcel adjacent to an "expressway" shall provide 75' of front setback " SECTION 2 The title of subsection (a) of Section 5, Chapter 4, Title XVII of the 1971 Code of Ordinances of Pueblo, Colorado is hereby amended to read as follows "(a) 0 -1, B -1, B -2, B -3, and B -4 Districts -- Performance Standards " SECTION 3 Subsection (a) of section 5, Chapter 4, Title XVII of the 1971 Code of Ordinances of Pueblo, Colorado is hereby amended by the addition of a new subsection (5) which reads as follows "(5) In an 0 -1 Zone district, only business wall signs and permanent window signs shall be per- mitted and shall be regulated as follows i) No wall sign shall extend more than fifteen (15) feet above building grade. ii) Only one (1) business wall sign shall be permitted and displayed to each street frontage iii) Window sign(s) shall not have a sign area in ex- cess of ten (10) percent of the area of the win- dow to which it is affixed iv) The combined total sign area of the wall sign and window sign(s) displayed to a street shall not exceed two times the square root of the pro- perty's frontage onto said street Examples are as follows -2- Frontage Square Root Total Sign Area 50 feet 7 1 14 2 sq feet 75 feet 8 7 17 4 sq feet 100 feet 10 0 20 0 sq. feet v) Signs shall be illuminated solely by stationary, shielded light sources directed to the sign; or by internal light sources producing not more than one -foot candle of illumination at a distance four feet from the sign. vi) Signs shall not (a) flash, blink, be animated, or emit noise; or (b) violate Section 15 -12 "Un- authorized signs, signals, or markings" of the Model Traffic Code for Colorado Municipalities as adopted by Section 15 -1 -1 of the Code of Ordinances " SECTION 4 Subsection (b) of Section 43, Chapter 4, Title XVII of the 1971 Code of Ordinances of Pueblo, Colorado is hereby amended to read as follows: "(b) Required number of spaces The number of spaces required for any publicly -owned facility in S -1 Zone shall be as determined by the Planning Commission. In all other zones, private places of assembly, such as theatres, auditoriums, and school or seminar rooms shall be provided with at least one off - street parking space for each six seats Office use shall be provided with at least five spaces, plus one additional space for each 400 square feet of net floor area in excess of 2,000 square feet Retail uses in the 0 -1, B -1, and B -2 Zones shall be pro- vided with at least ten spaces, plus one additional space for each 200 square feet of net floor area in excess of -3- 2,000 square feet Retail uses in the B -3, R -5, R -6, 1 -2 and I -3 Zones shall be provided with at least ten spaces, plus one additional space for each 250 square feet of net floor area in excess of 2,500 square feet. Retail use in a B -4 Zone shall be provided with at least one space for every 300 square feet of net floor area Wholesale, warehouse, industrial and manufacturing uses shall be provided with at least one space for every two employees anticipated to be employed on the largest shift Institutional uses, such as churches, hospitals, and private schools shall provide one parking space for every four adults expected to be present in the building at the time of maximum occupancy Open uses, not in buildings, shall be provided with at least one space for every two employees In the event these stand- ards do not appear reasonable when applied to a specific use or combination of uses, the administrative official or the applicant may apply for a variance, but the variance may not reduce or increase the required number of spaces by more than 25 per cent " SECTION 5 Section 51 of Chapter 4, Title XVII of the 1971 Code of Ordinances of Pueblo, Colorado is hereby amended by the addi- tion of the following new subsection "(9 2) NEIGHBORHOOD OFFICE DISTRICT (0 -1) (a) Purpose The standards of this district (0 -1) are designed to provide areas for limited of- fice and adjunct uses which may be introduced into residential areas without reduction of the character of the area (b) Uses by right (1) Accounting services -4- (2) Advertising agency (3) Architect (4) Architect, landscape (5) Chemist (6) Chiropodist (7) Chiropractor (8) Christian Science practitioner (9) Counseling Service (10) Consulting Service (11) Dentist (12) Detective and protective service (13) Dietician (14) Drafting and cartographic services (15) Engineer, professional (16) Financial office (17) Insurance agency (18) Interior decorator (19) Lawyer (20) Management and public relations (21) Midwife (22) Naturopath (23) Nurse, registered or practical (24) Nutritionist (25) Occupational therapist (26) Optometrist (27) Osteopath (28) Patent solicitor (29) Personnel supply service (30) Physical scientist (31) Physician (32) Physiotherapist (33) Psychologist -5- (34) Psychotherapist (35) Podiatrist (36) Real estate office (37) Referee in bankruptcy (38) Security and commodity service (39) Surveyor (40) Typing service (41) Utilities, as outlined in Section 17 -4 -30 (c) Uses by review A use by review is any of the following uses which are permitted only upon is- suance of a special use permit. (1) Agency office (2) Answering and paging service (3) Artificial limbs, fitting and custom manu- facturing (4) Bacteriological laboratory, non - manufacturing (5) Beauty and barber shop (6) Biological chemist, non - manufacturing (7) Biological laboratory, non - manufacturing (8) Blood bank or donor station (9p Charitable institution (office only) (10) Commercial artist (11) Commercial testing laboratory (12) Computer and data processing service (13) Dental laboratory (14) Government office (15) Medical laboratory, non - manufacturing (16) Optometric laboratory, repair and custom manufacturing (17) Pathological laboratory (18) Pharmacy (19) Residence - commercial -6- (20) School, private (21) X -ray laboratory, non- manufacturing" SECTION 6 If any part, subsection, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance, and the City Council hereby declares that it would have passed this Ordinance and each part, section, subsection, clause or phrase thereof, irrespective of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid SECTION 7 This Ordinance shall become effective immediately upon final passage and approval.
