A RESOLUTION AUTHORIZING THE ISSUANCE OF A
BUILDING PERMIT FOR THE PUEBLO COUNTY
JUDICIAL FACILITY
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Due to exigent circumstances, contemporaneously with the filing of a complete
subdivision application meeting all of the requirements of Chapter 4, Title XII of the
Pueblo Municipal Code as determined by the Director of Public Works (“Subdivision”)

for the land located between 4 and 6 Streets, between West and Elizabeth Streets
(“Property”), the City administration is hereby authorized to approve the issuance of a
building permit for a public building or structure to be constructed or installed on the
Property.
SECTION 2.
The building permit will be deemed revoked and cancelled if the owner of the
Property does not diligently pursue the Subdivision to final approval and recording on or
before October 1, 2013. No final Certificate of Occupancy shall be issued for any
building or structure constructed or installed on the Property pursuant to the Building
Permit until after the plat has been recorded. The conditions, restrictions, and
limitations set forth herein shall be incorporated in and made a part of the Building
Permit.

ISSUE
Should the City Council authorize the issuance of a building permit prior to the recording
of the subdivision?
RECOMMENDATION
Approval of the Resolution.
BACKGROUND
In an effort to expedite construction, a request has been made by Pueblo County for
approval by the City Council to allow staff to sign off on a building permit prior to a
recorded subdivision. This Resolution will authorize City administration to approve the
issuance of a building permit.
Said building permit will be revoked and cancelled if the owner of the property does not
diligently pursue the completion of the subdivision process. No final Certificate of
Occupancy shall be issued for any building or structure associated or installed on the
property until after the subdivision has been approved by the City Council and the plat
has been recorded.
