RESOLUTION NO 1976
A RESOLUTION.. APPROVING AN AGREEMENT BETWEEN THE CITY
OF PUEBLO 'AND SELLARDS & GRIGG, INC., CONCERNING
ENGINEERING SERVICES ON A MASTER STORM DRAINAGE PLAN
FOR LAND TRIBUTARY TO LAKE MINNEQ-UA AND AUTHORIZING
THE CITY MANAGER TO EXECUTE SAME
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that
SECTION 1.
A certain Agreement to perform engineering services for the
City of Pueblo on a Master Storm Drainage Plan for land tributary to
Lake Minnequa, dated March 11 , 1974, a copy of which is
attached hereto and made a part hereof by reference after having been
approved as to form by the City Attorney, by and between the City of
Pueblo, a Municipal Corporation, and Sellards and Grigg, Inc. a cor-
poration,8545 West Colfax Avenue, Lakewood, Colorado, be and the same
is hereby approved
SECTION 2.
The City Manager is hereby authorized to execute said Agree-
ment on behalf of the City of Pueblo, a Municipal Corporation, and the
City Clerk shall affix the seal of the City thereto and attest the
same.

A G R E E M E N T
THIS AGREEMENT, made and entered into as of this llth
day of March , A.D 197 4 , by and between the
City of Pueblo, a municipal corporation of the State of Colorado,
hereinafter referred tows the "CITY ", acting by and through its
duly authorized City Manager, hereinafter referred to as the
"MANAGER ", Party of the First Part, and Sellards & Grigg, Inc , a
corporation, having a place of business located at 8545 West Colfax
Avenue, Lakewood, Colorado, hereinafter referred to as the "CON-
SULTANT", Party of the Second Part.
W I T N E S S E T H
WHEREAS, the City is desirous of securing engineering and
technical support to the Department of Public Works; and
WHEREAS, under the Charter of the Citr of Pueblo, the Manager
is responsible for engineering architectural, maintenance, con-
struction and work equipment services required by the City; and
has authorization to contract for same for the City of Pueblo; and
WHEREAS, the Consultant, in the opinion of the Manager, has
the requisite qualifications for performing the work contemplated
herein and is adequately qualified; and
WHEREAS, the Consultant is now ready, willing and able, upon
execution of this Agreement, to provide to the City the services
provided for herein;
NOW THEREFORE, in consideration of the covenants and agree-
ments hereinafter contained, and of the payment of moneys herein -
after set forth the parties hereto mutually agree as follows
1 SCOPE OF THE WORK All work to be performed by the Con-
sultant shall be authorized in writing by the Manager,
said authorization to set forth all special conditions
and requirements not otherwise provided for in this
Agreement Upon written acknowledgement of said authori-
zation, special conditions and requirements the Consult-
ant shall furnish engineering manpower.in its opinion,
experienced to perform the services hereinafter defined

The scope of the work is more specifically described as
follows
The Consultant shall produce for the City, engineering
studies, surveys, analyses and such other work as
follows
A. Preparation of a general drainage basin map within the
general study limits as proposed on the attached
drawing #1. This map would indicate the following
1 Delineation of the major basins tributary to the
Arkansas River and Fountain Creek
2. Delineation of minor basins tributary to the
natural water courses of Dry Creek, Salt Creek
and an unnamed creek traversing northerly from
the Arkansas River through Sections 33, 28, 21,
16 and 9 of T2S, R64W
3 Delineation of natural and articifial sub - basins
within the minor basin referred to as the "Lake
Minnequa Basin" The "Lake Minnequa Basin"
refers to that land generally tributary to Lake
Minnequa and consists of all or part of Sections
10, 11, 12, 13, 14, 15, 16, 17, 20, 21, 22, 23,
26, 27, 28, 29, and 30 in T21S, R65W of the 6th
Principal Meridian
B Acquire, compile and analyze available information
and criteria within the "Lake Minnequa Basin ", relative
to the followings
1. Existing and proposed land use plans.
2. Drainage Ordinances of Record.
3. Hydrologic parameters relative to rainfall and
runoff
4. Topography (existing and available mapping)
5. Construction Cost Estimating Units
This part would define the basis for performing the
hydrologic analysis of the general plan and related

cost estimates Following this phase bf the "work
we propose a review session relative to this prior
to the completion of Parts C, D and E
C Analyze the adequacy of the existing storm drains
within the Lake Minnequa basin in accordance with
the criteria set forth in Part B In this regard
we propose to base the analysis on data obtained from
existing and available records, profiles, drawings
and maps.
D Preparation of a general drainage scheme for the
Lake Minnequa Basin. The scheme proposed would
indicate the general location of major drainage
facilities and would not necessarily indicate
minor requirements such as conduits under 36 inches
in diameter, manholes, inlets, etc (In this
regard the scheme would be presented in a manner
similar to Plate 2 of the Engineering Report
entitled, "Sanitary Sewerage and Waste Water Treat-
ment Facilities - City of Pueblo, November 1971 ")
In addition to the general drainage scheme described
above, a hydraulic analysis of Lake Minnequa will be
made relative to flood routing for the minor and
major storms The existing outlet works from Lake
Minnequa to the Arkansas River and the proposed
freeway outfall will be evacuated relative. to their
capacities to convey storm flow from the 'Lake to the
River. Overflow from Lake Minnequa during a rare
storm in excess of the capacity of the. existing" or
proposed underground outlet facilities will be
described in general terms to delineate areas of
concern or potential danger, however, it is not
considered a part of this study to specifically
define the limits of any such flood water
E. Preparation of project cost estimates for the devel-
opment of drainage facilities within the Lake Minne-
qua Basin The project cost for the Lake Minnequa
Basin would be determined by estimating the develop-
ment cost for the major drainage facilities as

outlined in Part D and increased by a factor to
reflect the cost of minor facilities (generally
conduits less than 36 inch diameter, manholes,
inlets, etc ) which were not specifically proposed
in general scheme. Parts A through E: would be
incorporated in report form and presented to,the
City.
Additional Work
In the event that the City desires additional work to be
performed under the terms, conditions, schedules or re-

vised dchedules of this Agreement, the Manager shall
make a request for additional work in writing to the
Consultant, setting forth a description of the work to
be performed and any additional conditions, schedules
or terms to be employed Following the receipt of such
a request, the Consultant shall review the request and
if the Consultant finds the request acceptable, he shall
acknowledge in writing, his willingness to accept the
request in accordancy with the terms set forth
II OBLIGATION OF THE CITY The City agrees to furnish, in
connection with this Agreement, the following
A. The Manager shall furnish in writing, the name or
names �f the City personnel who will be responsible .
for and with whom the Consultant shall direct and
coordinate the work under this Agreement
B. Design criteria, as needed to prepare construction
drawings and to define the scope of any particular
C. City records, legal opinions, maps, reports, survey
notes, legal descriptions and other documents which
have relationship to the job, upon request of the
Consultant
D. Right -of -way acquisitions.
E When available and applicable, standard drawings
and specifications which the City normally uses.

III MUTUAL OBLIGATIONS OF THE CITY AND THE CONSULTANT
The Parties mutually agree as follows
A. All the services contemplated under this Agreement
are personal and shall not be assigned sublet or
transferred without the written consent of the City
B The Consultant and any and all of its personnel util-
ized by the City under the terms of this Agreement
shall remain the agents and employees of the Consult-
ant and are not, nor shall be construed to be, agents
or employees of the City.
C The drawings, specifications, estimates, etc , pro-
duced by the Consultant under the terms of this
Agreement, when accepted and paid for by the City,
shall become the property of the City
D Whenever possible the period of performance of any
specific project undertaken by the Consultant shall
be mutually determined by the City and the Consult-
ant and stated in writing 30 days prior to the time
that notice to proceed on such work is given by the
City
IV PAYMENT AND FEE SCHEDULE It is understood and agreed .
by and between the parties hereto, that the City shall
pay the Consultant for services furnished, and the Con-
sultant shall accept as full payment for such services,
amounts•of money computed as follows
A Hourly rates of pay for time worked for classes of

B Additional expenses of the consultant which sha-11
be paid by the City as incurred by the Consultant
1 Services directly applicable to the work, such
as special legal, appraisal and accounting ex-
penses, computer rental and programming costs,
special consultants not previously defined,
laboratory charges and 'similar costs that are
not applicable to general overhead, actual cost
plus ten percent (10 %) Services to be author-
.;
ized by the City in writing
2 Transportation expenses at the rate of $0 12
per mile
3 Actual cost of long distance telephone calls and
telegrams
4 Reproduction of drawings at $0 10 per sq ft.
Sepias at $0.15 per sq ft.
5 Expendable supplies other than those normally
used in an engineering office, provided especi-
ally under this Agreement for the work involved
and for the benefit of the City -- actual cost
plus ten percent (10 %)
6. Actual cost of wood survey stakes and lath, and
other survey monuments required to complete
the project.
C. The Consultant shall maintain hourly records of time
worked by its personnel to support any audits the
City may require, and shall bill the City monthly
for costs accrued during the preceding month.. Bill -
ings shall be separated as necessary to - show direct
charges to specific projects or jobs. Upon submis-
sion:of such billings to the City, payment shall
be made within 30 days of submission.

D. The Fee Schedule described in Paragraphs IV -A
and IV -B above, shall be reviewed annually by
the City and the Consultant. Any request, by
either the City or the Consultant, to review the
schedule deacribed.in Paragraph IV -A and Para-
graph IV -B above will 'be made in writing and
submitted to the other party within ten (10)
days following the annual anniversary of the
date of this Agreement. Following a request
by either party to review the fee schedule,
the City and Consultant shall negotiate a re-
vised schedule within thirty (30) days of the
date of said request. In the event that the
City and the Consultant cannot come to an agree-
ment on a revised fee schedule, then the pro-
visions set forth in Paragraph VII hereof,
shall apply and payment shall be made in accor-
dance with the applicable. fee schedule of record.
If neither party requests a revision to the
said fee schedules within ten (10) days follow-
ing the annual anniversary of this Agreement,
the applicable fee schedule of record shall be
considered acceptable to both parties and shall
apply as the basis for compensations for services
rendered If an authorized project is delayed
or terminated by the Manager and subsequently
authorized for completion, fees for the remain-
ing portion shall be based upon the schedule
existing at the time authorization for comple-
tion is given Any project authorized by the
Manager shall be completed by the Consultant
under the fee schedule 'existing at the time of
authorization
V CHARTER, LAWS AND ORDINANCES The Consultant, at all:
times, agrees to observe all local, Federal and -
State laws, and all rules and regulations issued pursuant
thereto, which in any manner affect-or govern the

planning and construction work contemplated under this
Agreement, as the Consultant is advised in writing by the
City Attorney of the City of Pueblo
VI. TERMINATION: This Agreement may be terminated by either
party by seven (7) days written notice in the event of
substantial failure to perform in accordance with the
terms hereof by the one party through no fault of the
other party. If terminated due to the fault of others
than the Consultant, the Consultant shall be paid for
services performed to the date of termination, including
reimbursements then due, plus terminal expense
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement by its duly authorized representatives whose names are
submitted hereto as of the day and year first above written

Dear Mr Weisbrod
In accordance with your request we are pleased to submit this
proposal and enclosed agreement to perform engineering services
for the City of Pueblo. This proposal and agreement include
the preparation of a Master Storm Drainage Plan for land
tributary to Lake Minnequa. The basis for the work proposed
is in accordance with the proposed storm drainage policy
ordinance currently under review by your staff.
A breakdown of the work proposed is as follows
1. Delineation of the major and minor drainage basins
within and adjacent to the City This will assist
in evaluating the scope and magnitude of future
studies. The cost for this segment will be a minor
part of the total.
2. Delineation of the sub basins within the Lake Minne-
qua Basin and derivation of drainage criteria
relative to land use, return period and developer
responsibility. A question to be resolved and of
significance involves the distribution of cost for
facilities =within the southern portion of the Lake
Minnequa Basin containing several square miles of
land and held by only a few owners
3. Preparation of a Master Storm Drainage Plan and
cost estimate to delineate the facilities required
within the developed and undeveloped areas subject
to joint participation within the basin.
4. Hydrologic, hydraulic and flood routing analysis
for minor and major flow upon Lake Minnequa. This
analysis will evaluate the capacity of existing and
proposed drainage facilities down stream of Lake
Minnequa to convey the reservoirs overflow to the
Arkansas River. Overflow from the reservoir resulting
from a very rare storm upon the basin and in excess

ties' below. the reservoir shall be ,described to
indicate the general location overland floWand, d
areasof 5pecial concern. It is not the intent of
this proposal to delineate the potential flood
limits of such flooding below the reservoir -
The work described above would be prepared in report form
and wOuld—contaimorecommendations for development of drainage
facilities, cost estimates, unit basin fees and/or other
Parameters consistent with the storm drainage policy ordin-
ance acceptable to the City
We are prepared to commence the study immediately and estimate
that the work and final report will be completed within three , 1
to,six months depending upon the availability of obtaining 1
'records and information such as land use plans, topographic
data, a decision on developer responsibility as described in
Item_ 2 above, and other pertinent data.
We propose to work on an hourly rate basis for various 1 ),
classifications of personnel shown in the enclosed Agreement 1
and imate that--the total fee will range between $1p 1

We have considerable experience in this type of work 'having
prepared a similar 'type study for the City, of Englewood
and 'segments of other municipalities. We are currently
working on a "Tlood,Plain Information Report" on Salt Creek
for the Corps Of Engineers and information obtained from
this work will be of value in the Lake Minnequa Basin Study.
