AN ORDINANCE AMENDING CHAPTERS 2 AND 4 OF
TITLE XVII OF THE 1971 CODE OF ORDINANCES
RELATING TO TEMPORARY USES IN ZONE DISTRICTS
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PUEBLO,
COLORADO, that (Brackets indicates material being deleted and
underscoring indicates material being added)
SECTION 1
Chapter 2 of Title XVII of the 1971 Code of Ordinances
is hereby amended by the addition of a new subsection which
shall read as follows
(65.1) Use, temporary Any activity, occupation, business,
or operation carried on, or intended to be carried on, in
or from a tent, movable stand, portable equipment, or any
temporary building or structure, or in or from a truck,
trailer, or other vehicle, for a period not to exceed 30 days
in any calendar year (See temporary uses Section 17 -4 -32)
SECTION 2
Chapter 4 of Title XVII of the 1971 Code of Ordinances
is hereby amended by the addition of a new subsection which
shall read as follows
17 -4 -32 TEMPORARY USES
(a) Uses authorized Upon satisfaction of the require-
ments of this section, the Director of Finance may issue a
temporary use permit for any activity,. occupation, or business
which is permitted in the zone district wherein the use is
sought to be conducted, provided that such temporary,use does
not exceed 30,days in any calendar year
(b) Application A written application for a temporary
use permit shall be submitted to the Director of Finance con
taining the following information
(.1) The applicant's name and address and the name
and address of any person, firm, or corporation repre-
sented by such applicant in the application
(2) The interest of the applicant and the interest.
of the person(s), firm, or corporation represented by
the applicant, be it legal, sales, development,, operation
or other interest
(3) The nature of the temporary use, the street
address, legal description and property owner of the
property for which the temporary use permit is requested
(4) A brief statement of facts which the applicant
believes justifies the temporary use permit
(5) A plat drawn to scale showing the dimensions
a of the property and the location of improvements with
respect to property lines for which the temporary use
permit is requested
(6) A certificate of zoning compliance from the
Director of Zoning shall accompany every application for
a temporary use permit
(c) Issuance of permit After consultation with or
inspection by the appropriate representatives of the Police,
Fire, and Pueblo Regional Building Departments, and after any
other necessary permits are obtained, the Director of Finance
may issue a nontransferrable temporary use permit to the
applicant provided it is determined that no danger to the
health, safety, or welfare of the public is presented
(d) Permit fee Each applicant for temporary use permit
shall submit with the application a $100 00 permit fee,
$75 00 of which shall be refundable at the conclusion of the
proposed activity, provided, however, that all appropriate sales
tax is paid to the City and the property is cleaned of all
trash, garbage, debris or temporary buildings and structures
attributable to the proposed activity All clean -up costs
shall be deducted from the amount to be refunded
SECTION 3
This Ordinance shall become effective immediately upon
final passage and approval
