ORDINANCE NO. 8357
AN ORDINANCE APPROVING A SPECIAL AREA PLAN
FOR VINCI SUBDIVISION, A SPECIAL AREA PLAN
WHEREAS, a request for a Special Area Plan for the Vinci Subdivision, a Special
Area Plan, has been submitted to the Planning and Zoning Commission for approval
pursuant to Section 17 -4 -29 of the Pueblo Municipal Code, and
WHEREAS, the Planning and Zoning Commission after a public hearing found
and determined the objectives and requirements of said Section 17 -4 -29 can and will be
met, and
WHEREAS, the Planning and Zoning Commission has recommended the
approval of the Special Area Plan for the Vinci Subdivision, a Special Area Plan,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Special Area Plan for:
A PORTION OF THE SOUTHEAST QUARTER OF THE SOUTHWEST QUARTER OF
SECTION 4, TOWNSHIP 21 SOUTH, RANGE 65 WEST OF THE 6TH PRINCIPAL
MERIDIAN, CITY OF PUEBLO, COUNTY OF PUEBLO, STATE OF COLORADO, AND
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BASIS OF BEARINGS: THE NORTHERLY LINE OF SAID SOUTHEAST QUARTER
OF THE SOUTHWEST QUARTER OF SECTION 4, BEING MONUMENTED AT EACH
END BY A NO. 6 REBAR WITH 21/2" ALUMINUM CAP STAMPED AS SHOWN, AND
BEING ASSUMED TO BEAR S88 °07'38 "E A DISTANCE OF 1313.63 FEET.
BEGINNING AT THE CENTER SOUTH 1/16 CORNER OF SAID SECTION 4, BEING A
POINT ON THE SOUTH RIGHT -OF -WAY LINE OF RED CREEK SPRINGS ROAD;
THENCE S03 °43'37 "W, ON THE EAST LINE OF THE SOUTHEAST QUARTER OF
THE SOUTHWEST QUARTER OF SECTION 4, A DISTANCE OF 290.21 FEET;
THENCE N88 °03'34 "W A DISTANCE OF 151.56 FEET; THENCE N01 °58'28 "E A
DISTANCE OF 289.88 FEET TO THE SOUTH RIGHT -OF -WAY LINE OF RED CREEK
SPRINGS ROAD; THENCE S88 °07'38 "E, ON SAID RIGHT -OF -WAY, A DISTANCE OF
160.44 FEET TO THE POINT OF BEGINNING;
CONTAINING A CALCULATED AREA OF 45,237 SQ. FEET, OR 1.038 ACRES.
attached hereto, is hereby approved.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval.

AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR VINCI SUBDIVISION, A
SPECIAL AREA PLAN
ISSUE
Shall City Council approve the Special Area Plan to allow for the unique development of
the Vinci Subdivision?
RECOMMENDATION
The Planning and Zoning Commission, at their April 13, 2011 Regular Meeting, voted 4-
0 to recommend approval with conditions. Subsequently the conditions of approval
have been met by the applicant, with the following exception:
The Planning and Zoning Commission recommended the Special Area Plan be
approved with the condition that the front yard setback from Serenity Place should be
20’ and must be shown from edge of the Serenity Place easement. After discussion
with the applicant, the existing structure is constructed at 15’ from the edge of the
Serenity Place edge of easement. Staff is recommending City Council approve the
Special Area Plan with the revision of the front yard setback from Serenity Place shown
on the Plan to be 15’ from edge of the Serenity Place easement.
BACKGROUND
The applicant is requesting the Special Area Plan to facilitate subdivision of the property
in a manner that would not be permissible under the R-2 Zone District. The subdivision
will create 3 lots, but the lots will not front onto a public street. The proposed
subdivision and Special Area Plan will allow access to be provided to all lots via a
private street (Serenity Place). In addition, the applicant is requesting to modify the
setbacks from the front, but will maintain the required setbacks along the periphery of
the subdivision.
