AN ORDINANCE AMENDING TITLE XVII, CHAPTER 4,
ZONING, OF THE 1971 CODE OF ORDINANCES RELATING
TO SETBACK AND CONSTRUCTION REQUIREMENTS FOR
ACCESSORY BUILDINGS
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO,
that (Brackets indicate material deleted by this amendment;
underscoring indicates new material)
SECTION 1
Section 23, of Chapter 4, Title XVII of the 1971 Code
of Ordinances of Pueblo, Colorado, passed and approved by Ordi-
nance No 3476 on September 27, 1971, is hereby amended to read
as follows
"17 -4 -23 Accessory Buildings
No accessory building shall be erected in any
required front, side or rear yard, and no separate accessory
building shall be erected within five feet of any other
building, except that one-story accessory buildings may be
built to occupy not more than 30% of the rear yard nor more
than the rear 75% of one side yard; provided [such building
shall be constructed entirely without setback from the side
or rear property lines aside from dedicated utility easements
and provided further that the wall abutting upon the property
line shall be of 2 -hour fire - resistive, construction as de-
fined in the Uniform Building Code adopted by section 4 -1 -1
of this Code, shall contain no openings, and the roof shall
not overhang or shed water on adjoining property] that any
such building occupying any required side or rear yard if
'such ;building is located less than five (5) feet from any
Isr:op line, shall be so constructed that the wall(s) ad-
jacent to the property line(s) shall be of 2 -hour fire -
resistive construction as defined in the Uniform Building .Code
as adopted by Section 4 -1 -1 of the 1971 Code of Ordinances of
Pueblo, shall contain no openings, and the roof shall not
overhang or shed water on adjoining property; and provided
further, that no building shall be placed upon land within
a dedicated utility or drainage easement "
SECTION 2
This Ordinance shall become effective immediately upon
final passage and approval
