AN ORDINANCE VACATING THE SOUTH FIVE FEET OF
12 STREET ADJACENT TO BLOCK 27, WEST SIDE
ADDITION
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described right -of -way
THE SOUTH 5 FEET OF 12TH STREET FROM THE EASTERLY RIGHT
OF WAY OF JASPER STREET TO THE SOUTHWESTERLY RIGHT -OF-
WAY LINE OF THE DENVER & RIO GRANDE WESTERN RAILROAD
ADJACENT TO BLOCK 27, WEST SIDE ADDITION, ACCORDING TO
THE RECORDED PLAT THEREOF, FIELD FOR RECORD OCTOBER
31, 1890 IN BOOK 7 AT PAGE 8, RECEPTION NO 44215 IN THE
RECORDS OF THE PUEBLO COUNTY CLERK AND RECORDER
is hereby vacated
SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval

Shall City Council approve the proposed vacation of the south five feet of 12 Street
adjacent to Block 27, West Side Addition?
RECOMMENDATION
The Planning and Zoning Commission, at their March 9, 2011 Regular Meeting, voted
6-0 to recommend approval with conditions. Subsequently, all conditions of approval
have been met by the applicant.
BACKGROUND
West Side Addition, recorded in 1890, created a 73 block subdivision, which dedicated

12 Street for 12 blocks. By the 1900s the Denver & Rio Grande Western Railroad was
thth
constructed, cutting off 12 Street one block east of Jasper Street. Currently, 12
Street between Jasper and the railroad is a dirt pathway that has never been improved
or maintained and likely will never be improved.
In 1995, an office building was constructed, but was inadvertently constructed off
th
property. The office building encroaches approximately 3.5’ into the 12 Street right-of-
way. In addition, an air conditioner unit, fence and retaining walls are also constructed
th
in the 12 Street right-of-way. The applicant has obtained a revocable permit to allow
th
these items to remain. A water main exists in the northern portion of 12 Street, which
th
eliminated the possibility of a full vacation of 12 Street.
