AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XI OF
THE PUEBLO MUNICIPAL CODE RELATING TO
IMPOUND AND LICENSING FEES
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate
matter being deleted, underscoring indicates new matter being added)
SECTION 1.
Section 11-4-16 of Chapter 4, Title XI, Pueblo Municipal Code, as amended, is
hereby amended to read as follows:
Sec. 11-4-16. Disposition of impounded animals.

(b) Any impounded animal may be redeemed by the owner upon payment of
the impound fee, care and feeding charges, veterinary charges, if any, and such
other charges as periodically established by the City or designated Shelter
Operator. If the animal has not been vaccinated for rabies and is required by the
provisions of this Chapter to be so vaccinated, the owner shall not be given
custody of the animal until steps are taken to so vaccinate the animal. Unless
otherwise modified by resolution of the City Council or by the designated Shelter
Operator, the redemption amounts identified herein shall be charged.
(1) Redemption amounts; impoundment. The redemption amount for

SECTION 2.
Section 11-4-45 of Chapter 4, Title XI, Pueblo Municipal Code, as amended is
hereby amended to read as follows:
Sec. 11-4-45. Licenses; expiration; fees.
(a) Licenses and tags may be issued and be valid for one (1) year or three (3)
years from the date of issuance.

(b) The license fee for one (1) year shall be twenty dollars ($20.00)

(f) Veterinarians issuing a license under this Section shall retain one dollar
($1.00) for each one year license issued and three dollars ($3.00) for each three-
year license issued and shall surrender the balance of all license fees collected
as the License Officer may direct.
(g) No license fee shall be required for:
(1) Guide dogs for the blind or deaf;
(2) Service dogs used by the handicapped; or
(3) Law enforcement service and rescue dogs.

(h) The City Council may by resolution increase or decrease the
fees, boarding fees,
license fees and litter registration fees.
(i) All license fees and litter registration fees shall be paid to and collected by
and/or the Shelter Operator.

ISSUE
Should the City Council amend the City’s Animal Control Code to increase boarding,
impounding and licensing fees and to allow the Animal Shelter to retain all license and
litter registration fees collected under Chapter 4 of Title XI of the Pueblo Municipal
Code?
RECOMMENDATION
Pikes Peak Humane Society has requested the Ordinance.
BACKGROUND
The costs associated with the boarding, impounding and licensing of dogs and cats in
Pueblo has increased. The Pikes Peak Humane Society, which operates the Animal
Shelter, has advised that a fee increase is necessary to cover the increased costs. The
fees proposed would still be lower than those currently in place in Colorado Springs and
El Paso County. The last fee increase occurred in 2005.
Currently, the Shelter Operator retains only twenty-five percent (25%) of the revenue
generated from licensing and litter registration fees. The proposed ordinance will allow
the Shelter Operator to retain one hundred percent (100%) of all licensing and litter
registration fees collected.
The fee increases and retention of one hundred percent (100%) of the licensing
revenue by the Shelter Operator, will allow the Shelter Operator to better perform its
duties.
FINANCIAL IMPACT
Allowing the Shelter Operator to retain one hundred percent (100%) of all future
licensing revenue will result in a loss of approximately $6,512 from the City’s general
fund.
