RESOLUTION NO. 12099
A RESOLUTION ACCEPTING A TEMPORARY EASEMENT
FROM OWNERS OF REAL PROPERTY LOCATED ON THE
NORTHWEST CORNER OF THE INTERSECTION OF
GREENHORN DRIVE AND LIME ROAD
WHEREAS, the temporary easement is necessary to provide a truck turn-around
for water transport vehicles.
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.

The temporary easement dated May 12, 2010, copies of which is attached
hereto, having been approved as to form by the City Attorney, is hereby approved and
accepted.
SECTION 2.
The City Clerk is directed to cause said easement to be recorded in the office of
the Pueblo County Clerk and Recorder forthwith.

Should City Council accept a temporary easement adjacent to Greenhorn Drive to
accommodate a truck turn around for a water transport vehicle?

BACKGROUND
This temporary easement is necessary to provide a truck turn around on Greenhorn
Drive north of Lime Road, adjacent to the Board of Water Works tank site.

THAT IN CONSIDERATION oldie sum of One Dollar ($I 00) and other good an valuable
consideration, paid by the GRANTEE, receipt of which is hereby acknowledged, GRANTOR herby grants to
GRANTEE, its successors and assigns, a temporary easement over 5 790+ square foot of GRANTOR s Property
for the purpose of public roadway as the Greenhorn Drive temporary turn - around, in. through. over under and
across GRANTOR S property situated in Pueblo County Colorado. and described as follows (the Property)
Beginning at a point which is the intersection of the westerly Right of Way Line of
Greenhorn Drive and the northerly Right of Way of Lime Road, thence N00' 15 1 1 E
which is the basis of all bearings as shown on the Annexation Plat of Vestas Phase L
along said westerly Right of Way a distance of 190 00 feet, thence N89 °44 49' W a
distance of 30 00 feet thence S00 °15 1 1 'W a distance of 192.52 feet to a point on the
northerly Right of Way of Lime Road, thence N85 °27 36 'F along said northerly Right
of Way a distance of 30 12 feet to the Point of Beginning. Said Easement contains
5 738+ square feet.
TOGETHER WITH the right to enter upon the Property for the purposes of construction, replacement.
maintenance, control, and repair The GRANTOR reserves the right to use and occupy the Property for any
purpose not inconsistent with the right and privilege above granted and which will not interfere with or endanger
any of GRANTEE S equipment or facilities therein or use thereof Such reservation by the GRANTOR shall in
no event include the right to locate or erect or cause to he located or erected on the Property any building or any
other structure or manufactured or mobile home or trailer unit. This easement shall automatically terminate at
such time as Greenhorn Drive is extended north to its existing terminus or upon platting of subject property
whichever shall occur first
GRANTOR warrants to GRANTEE the GRANTOR (a) has good and sufficient right and title in and to
the Property and full power to grant this temporary easement and right -of way and (b) will defend GRANTEE'S
quiet and peaceful possession oldie Property and temporary easement and right -of -way against all persons who
may lawfully claim title to the property
'GRANTEE' shall include the plural and the feminine. The Temporary Easement shall be binding upon.
