A RESOLUTION APPROVING THE TRANSFER OF
APPROPRIATED WASTEWATER FUNDS BETWEEN
PROJECTS
WHEREAS, the City of Pueblo owns, operates and maintains a wastewater
collection and treatment system subject to the requirements of the Federal Clean Water
Act and the Colorado Water Quality Control Act; and
WHEREAS, the City Council has authorized construction of a multi-segment
Ammonia Removal construction project, and
WHEREAS, the City of Pueblo has already obtained funding for $26,100,000 of
the project to be split between the different segments of the project, and
WHEREAS, the City has appropriated $1,300,000 to Projects to be Determined,
and $100,000 of this is needed for the Ammonia Removal Project.
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Finance Director is hereby authorized to execute the transfer of $800,000
from Section 6 (WWL02B) of the Ammonia Removal Project to the remaining Five
Sections (WWL01A – WWL02A) of the Project as well as the transfer of $100,000 from
Projects To Be Determined (WW1199) in the name and on behalf of the City and the
City Clerk is directed to affix the seal of the City thereto and attest same.
SECTION 2.
Funds for said Transfer in an amount not to exceed $900,000 shall be paid from
appropriated and unencumbered funds budgeted in the City’s 2010 and 2011 Budgets.

ISSUE
Should the City Council approve the transfer of $800,000 of available budget from the
Ammonia Removal Project, Section 6 (WWL02B), WRF Solar Photovoltaic, as well as
$100,000 of available budget from Projects to be Determined (WW1199), to projects
within the first five segments of the Ammonia Removal Project (WWL01A through
WWL02A)?
RECOMMENDATION
Approval of Resolution.
BACKGROUND
The Ammonia Removal Project was designed in six different segments. Segments 1 –
5 are being funded through a $25,000,000 SRF loan. Segment 6 (the solar
photovoltaic) has been funded through a $1,500,000 ARRA loan and sewer user funds.
It is difficult to determine if the costs of construction projects will bid under the estimated
amounts. Change orders will also affect the final cost.
Segment 6 is complete, with the exception of the final payment to be made to the
contractor; remaining funds of approximately $800,000 will be transferred and used in
the first five segments. The additional $100,000 to be moved from Projects to be
Determined (WW1199) will also be transferred and used in the first five segments.
Below is a table depicting the projects and their respective budgets.

FINANCIAL IMPACT
Funds for the Ammonia Removal Project have already been appropriated, but are
needed in other segments of the Project. Additional funds have been appropriated in
Projects to be Determined and is needed in the Ammonia Removal Project.
