HomeMy WebLinkAbout12087 RESOLUTION NO. 12087 A RESOLUTION GRANTING A QUIT CLAIM DEED TO ANGELA BUMSTEAD FOR REAL PROPERTY LOCATED WITHIN LOTS 1 AND 2, BLOCK 2, THE KELLY ADDITION TO PUEBLO COLORADO, WITHIN THE CITY OF PUEBLO, COLORADO BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Quit Claim Deed granting real property to Angela Bumstead, having been approved as to form by the City Attorney, is hereby authorized and approved. SECTION 2. The City Clerk is directed to record said deed in the office of the Pueblo County Clerk and Recorder. TITLE A RESOLUTION GRANTING A QUIT CLAIM DEED TO ANGELA BUMSTEAD FOR REAL PROPERTY LOCATED WITHIN LOTS 1 AND 2, BLOCK 2, THE KELLY ADDITION TO PUEBLO COLORADO, WITHIN THE CITY OF PUEBLO, COLORADO ISSUE Should City Council grant a Quit Claim Deed to Angela Bumstead? RECOMMENDATION Approval of this Resolution. BACKGROUND The original alignment of the sanitary sewer line built within the alley of Block 2, The Kelly Addition to Pueblo Colorado, diverged from the dedicated alley alignment encroaching into the southerly portions of Lots 1, 2, 3, 4 of said Block 2, creating a City- owned parcel adjacent to 404, 412 and 414 Ash Street. In 1989, the City of Pueblo Department of Public Works completed a sanitary sewer rehabilitation project which realigned the sewer line to fall within the platted alley of said Block 2. Because of this realignment, the parcel is no longer needed by the City. On December 22, 2008, the City quit claimed a portion of said parcel to the adjacent owner at 404 Ash. (Resolution 11491) The owner of 412 Ash, Mrs. Angela Bumstead, is now requesting that the remnant portion of land adjacent to her property also be quit claimed. The owner of 414 Ash has declined to accept the final remaining portion of said parcel adjacent to that property. FINANCIAL IMPACT None. Reception 1867825 02/18/2011 QUIT CLAIM DEED THIS DEED, made this 14th day of February , 2011 between Pueblo, a Municipal Corporation, of the first part, and Angela Kathryn Bumstead, of the second part, WITNESSETH, That the said party of the first part, for and in consideration of the sum of One Dollar ($1 00) to the said party of the first part in hand paid by the said party of the second part, the receipt whereof is hereby confessed and acknowledged, hath remised, released, sold, conveyed and QUIT CLAIMED, and by these presents doth remise, release, sell, convey and QUIT CLAIM unto the said party of the second part, its successors and assigns forever, all of the right, title, interest, claim and demand which the said party of the first part hath in and to the following described real property situate, lying and being in the County of Pueblo and State of Colorado, to wit: See Exhibit "A" also known as 412 Ash Street, Pueblo, Colorado TO HAVE AND TO HOLD the same, together with all and singular the appurtenances and privileges thereunto belonging, or in anywise thereunto appertaining, and all the estate, right, title, interest and claim whatsoever, of the said party of the first part, either in law or equity, to the only proper use, benefit and behoof of said party of the second part, his heirs and assigns forever Grantee takes said right, title and interest of said party of the first part subject to all hens, encroachments, leases and environmental conditions, including both those of record and those not of record.
