ORDINANCE NO 5573
AN ORDINANCE AMENDING TITLE IX, LICENSES AND
PERMITS, OF THE 1971 CODE OF ORDINANCES OF THE
CITY OF PUEBLO BY REPEALING SUBSECTION (C) OF
SECTION 7 OF CHAPTER 1, SUBSECTION (C) OF
SECTION 9 OF CHAPTER 1 AND SECTION 10 OF
CHAPTER 1, AND AMENDING SUBSECTION (A) OF
SECTION 11 OF CHAPTER 1 TO CHANGE LICENSING
PROCEDURES AND TO INCREASE THE PENALTIES
PROVIDED FOR LATE FILING OF LICENSE RENEWAL
APPLICATIONS
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that (Brackets
indicate material being deleted; underscoring indicates new
material being added )
SECTION 1
Subsection (c) of Section 7 of Chapter 1 of Title IX is
repealed in its entirety
[(c) Adjustment of Fee The License Officer shall
(1) Change in License Status. Where applicable,
require the payment of an additional or higher license fee,
to be prorated for the balance of the license period, when a
licensee places himself in such status under this Code by:
(A) Increasing the number of his employees
(B) Augmenting the volume of business done by him
(C) Expanding the size of business, plant or
premises
(D) Increasing the number or size of his vehicles
(E) Making any other lawful and material change of
any kind in his business.
(2) Prorated Fee on Voluntary Retirement. Unless
otherwise specifically provided, refund a proportion of the
amount of fee already paid, prorated for the balance of the
license period, upon notification by a licensee of his volun-
tary retirement from business.
(3) Prorated Fee for New Business Unless other-
wise specifically provided, prorate for the balance of any
license period the license fee of any business commenced
after the beginning of the license period.]
SECTION 2.
Subsection (c) of Section 9 of Chapter 1 of Title IX is
repealed in its entirety
[(c) New Location Desired A licensee shall have the
right to change the location of the licensed business or
machine provided he shall
(1) Approval of License Officer Obtain permis-
sion from the License Officer for such change of location
(2) Payment of Fee Pay a removal fee of $1 00 to
the License Officer ]
SECTION 3
Section 10 of Chapter 1 of Title IX is repealed in its
entirety:
[TRANSFER OF LICENSE
(a) When Authorized. Unless otherwise specifically
prohibited, a licensee hereunder shall have the right to
transfer his license to another location or another person
provided he shall
(1) Approval of License Officer. Obtain written
permission from the License Officer for such transfer.
(2) Method of Transfer Execute the transfer in
the form and under the conditions required by law and as
prescribed by the License Officer
(3) Notification. Promptly report the completed
act of transfer to the License Officer
(4) Surrender License Promptly surrender any
license certificate and, when required by the License
Officer, all licensing insignia.
(b) New License Issued Upon the completion of a
transfer of license in compliance with subsection (a) above,
the License Officer shall issue a new license and insignia to
the transferee or for a new location for the unexpired term
of the old license
(1) Effect of New License. The new license issued
hereunder shall authorize the transferee to engage in the

same business at the same location or at such other place as
shall be approved by the License Officer and named in the new
license.
(2) Transfer Fee The License Officer shall
collect a transfer fee of $1.00 from the transferee prior to
the issuance of the new license l
SECTION 4.
Subsection (a) of Section 11 of Chapter 1 of Title IX is
hereby amended to read as follows
9 -1 -11 RENEWAL FEE, APPLICATION
(a) Unless otherwise provided, any annual license may
be renewed upon filing application for same and payment of
the annual license fee A delinquent license may be renewed
within 30 days after becoming delinquent [upon] without
payment of a delinquency fee [of 25% of the annual license
fee in addition to the annual license fee,] [if] A
delinquent license may be renewed more than 30 days [but
within 60 days after becoming delinquent, upon payment of a
delinquency fee of 50% of the annual license fee additional,
and if renewed more then 60 days] but less than 90 days after
becoming delinquent, [then] upon payment of a delinquency fee
of [75 %] 100% of the annual license fee [additional] in
addition to the annual license fee. The License Officer
shall [automatically] suspend the license of any person or
premises delinquent more than 90 days and such suspension
shall remain in force until all annual fees and a delinquent
fee of 100% of the annual fee, and all other charges or debts
owing to the City, shall have been paid in full.
SECTION 5.
This Ordinance shall take effect January 1, 1990 and shall
apply to all license renewal applications filed on or after that
date.
