A RESOLUTION APPROVING THE DEVELOPMENT PLAN
REVIEW FOR THE LOCATION OF PLAYGROUND
EQUIPMENT WITHIN THE NEIGHBORHOOD PARK IN
UNIVERSITY PARK
WHEREAS, a public meeting was held by the City Council on November 10, 2010 to
review alternatives for the placement of new playground equipment at the neighborhood
park in University Park and receive public comments regarding the location of the new
playground; and
WHEREAS, prior to any final action by City Council, the Parks and Recreation
Advisory Committee and the Planning and Zoning Commission reviewed the alternatives for
the placement of the new playground equipment and provided recommendations to City
Council; and
WHEREAS, the Parks and Recreation Advisory Commission at its December 1,
2010 meeting voted unanimously to recommend approval of Parks and Recreation
Department’s preferred location for the playground equipment; and
WHEREAS, the Planning and Zoning Commission after a public hearing found and
determined the objectives and requirements of said Section 17-4-51 can and will be met;
and
WHEREAS, the Planning and Zoning Commission has recommended the approval
of the Development Plan Review within the neighborhood park in University Park;
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Development Plan Review for:
PARCELS A + B COLLEGE PARK SUB 2ND and PARCEL D BLK 2
UNIVERSITY PARK SUB 10TH
is hereby approved.
SECTION 2.
The Development Plan Review is approved with the condition that the plans and
structure concepts submitted to the Planning and Zoning Commission shall be the approved
plans. Any alteration, modification, substitution, or revision, including but not limited to
colors, materials, building placement, or massing shall be at the discretion of the Director of
Planning and Community Development, who reserves the right to require said changes to
be reviewed and approved by the Planning and Zoning Commission.
SECTION 3.
This Resolution shall become effective immediately upon final passage and
approval.

ISSUE
Shall City Council approve the Development Plan Review for location of playground equipment
at the intersection of Ironweed Drive and Cedarweed Boulevard in University Park?
RECOMMENDATION
The Planning and Zoning Commission, at their January 12, 2011 Regular Meeting, voted 6-0 to
recommend approval with the following condition:
The plans and structure concepts submitted to the Planning and Zoning Commission shall be
the approved plans. Any alteration, modification, substitution, or revision, including but not
limited to colors, materials, building placement, or massing shall be at the discretion of the
Director of Planning and Community Development, who reserves the right to require said
changes to be reviewed and approved by the Planning and Zoning Commission.
The Parks and Recreation Advisory Committee, at their December 1, 2010 meeting, voted 6-0
to recommend approval of the Parks and Recreation Department’s preferred location of the new
playground at University Park.
BACKGROUND
The replacement of the playground equipment at University Park was included in the Pueblo
County 1-A Ballot Question passed by Pueblo County voters in 2006. The current location of
the playground equipment at University Park is problematic for multiple reasons: 1) the
playground is located at the bottom of a hill, 2) the playground has no direct visibility from a
road, parking lot or other public space, 3) access to the playground does not meet Americans
with Disabilities Accessibility Guidelines for accessible surface, ground-mounted elements, and
possibly the accessible route, 4) it is one of the most vandalized and graffiti-prone playgrounds
in the City, and 5) especially during the summer, this park receives numerous complaints to the
Police Department regarding after-hours use, loud and in-appropriate behavior due to its “out-of-
sight” location.
FINANCIAL IMPACT
The project will be funded through the use of Pueblo County 1-A funds.
