HomeMy WebLinkAbout08298Reception 1863365 01/03/2011 ORDINANCE NO 8298 AN ORDINANCE REPEALING ORDINANCE NO 8167, AND CHANGING THE STREET NAME OF OLD SMELTER ROAD TO GRUMA DRIVE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 City Council finds that Ordinance 8167, passed and approved on March 8, 2010, changing the street name of Old Smelter Road to Gruma Drive was based upon the erroneous information and belief that it was a private road In fact, Council finds that Old Smelter Road has been used as a public roadway for over 20 years Old Smelter Road is designated as such on all City maps and the City has paid to maintain the road SECTION 2 Ordinance No 8167 is hereby repealed nunc pro tunc March 8, 2010 SECTION 3 The name of the public street currently known as Old Smelter Road is hereby changed to Gruma Drive, which shall be and remain a public street. Florczak, City Attorney TITLE AN ORDINANCE REPEALING ORDINANCE NO. 8167, AND CHANGING THE STREET NAME OF OLD SMELTER ROAD TO GRUMA DRIVE ISSUE Should the City Council repeal Ordinance No. 8167 passed and approved on March 8, 2010 and change the name of the public roadway named Old Smelter Road to Gruma Drive? RECOMMENDATION Approve the Ordinance. BACKGROUND On March 8, 2010, the City Council approved Ordinance No. 8167 changing the name of Old Smelter Road to Gruma Drive. The change in name was requested by Mission Foods. However, at the time, there existed a mistaken belief that Old Smelter Road was a private road until it crossed the railroad tracks where it turned into Clarence Road, a public road. In fact, all of Old Smelter Road has served as a public roadway for over twenty years. Old Smelter Road has been designated as a public roadway on all city maps. The City has expended resources to maintain the road. In reliance upon Ordinance No. 8167, Mission Foods has changed its stationery and business documents to reflect its location on Gruma Drive. This Ordinance effects the requested name change from Old Smelter Road to Gruma Drive, but recognizes that the road has been and remains a public roadway. FINANCIAL IMPACT None anticipated.
