HomeMy WebLinkAbout08284ORDINANCE NO. 8284 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R-3, ONE AND TWO-FAMILY RESIDENTIAL DISTRICT TO B-4, REGIONAL BUSINESS DISTRICT COVERING A PARCEL OF LAND COMMONLY KNOWN AS 1309 EAST ORMAN AVENUE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from R-3, One and Two-Family Residential District to B-4, Regional Business District, and upon passage of this Ordinance, zoning restrictions affecting B-4, Regional Business District, shall apply to said property as follows: LOTS 44, 45, 46, 47 and 48 OF BLOCK 1 LAKE AVENUE ADDITION, COUNTY OF PUEBLO, STATE OF COLORADO, LESS A PORTION OF LOT 48 DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHEAST CORNER OF SAID LOT 48, THENCE SOUTH ALONG THE EAST LINE OF SAID LOT 48, A DISTANCE OF 16.00 FEET; THENCE NORTHWESTERLY A DISTANCE OF 116.43 FEET TO THE WEST LINE OF SAID LOT 48 A DISTANCE OF 6.00 FEET TO THE NORTH LINE OF SAID LOT 48; THENCE EAST A DISTANCE OF 116.00 FEET TO THE P.O.B. ALSO KNOWN AS "PARCEL A REARRANGEMENT OF PROPERTY BOUNDARIES" RECORDED AT RECEPTION NO. 1816119 ON AUGUST 20, 2009. and more commonly known as: 1309 East Orman Avenue SECTION 2. RECOMMENDATION The Planning and Zoning Commission, at their April 16, 2009 Regular Meeting, voted 5- . 0 to recommend approval with conditionsSubsequently, all conditions of approval have been met by the applicant. BACKGROUND The applicant is requesting to rezone the subject site to B-4 in order to facilitate commercial redevelopment of the residential site. The applicants propose to construct a 2,128 square foot building to house the Abba Eye Care business; and the existing Abba Eye Care, located adjacent to Northern Avenue, will be leased as commercial office space. The applicants have submitted a Rearrangement of Property boundaries application to consolidate both parcels (Lots 45-48, Block 1, Lake Avenue Addition) into one large commercial parcel that will house two principal structures. Eleven parking spaces will be provided on site, with four located in the parking area adjacent to the west half of the alley. FINANCIAL IMPACT None.
