HomeMy WebLinkAbout02813 F r RESOLUTION NO 2813 ° (?) 6 \ A RESOLUTION APPROVING AN AMENDED LEASE AGREE- MENT BETWEEN THE WESTMINISTER UNITED PRESBYTERIAN CHURCH AND PUEBLO, A MUNICIPAL CORPORATION, AND AUTHORIZING THE PRESIDENT OF THE COUNCIL TO EXECUTE SAME BY IT RESOLVED THE CITY COUNCIL OF PUEBLO, COLORADO that SECTION 1 A certain Amended Lease Agreement dated November 22, 1971, between the Westminister United Presbyterian Church, lessor, and Pueblo, a Municipal Corporation, lessee, a copy of which is at- tached hereto and made a part hereof by reference, after having been approved as to form by the City Attorney, relating to the leasing of a parcel of land located in the Southwest corner of church property to be used for the purpose of public playground, park and similar related recreational facilities is hereby approved SECTION 2 The President of the Council is hereby authorized to execute said Amended Lease Agreement on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same INTRODUCED November 22, 1971 BY HENRY REYES Councilman AP PROVED• „,__S)\\ President of,,ie Co c l ATTEST '\,/22 6/04-- / / city/ Clerk U ' F 1 AMENDED LEASE AGREEMENT This Amended Lease entered into this 22nd day of November, 1971, by and between THE WESTMINISTER UNITED PRESBYTERIAN CHURCH, Lessor, and PUEBLO, A MUNICIPAL CORPORATION, Lessee, WITNESSETH In consideration of the sum of One Dollar and the covenants herein specified, said Lessor hereby leases unto said Lessee the right and privilege to occupy and use the following described real property situate in the City and County of Pueblo, and State of Colorado A Parcel of land approximately 500' [E -W] by 170' [N -S] located in the Southwest Corner of the Church property, to be used for the purpose of public playground, park, and simi- lar related recreational facilities, for a term of ten [10] years expiring on January 1, 1982 Lessee shall have the right, option and privilege to review this amended lease for an additional term of ten [10] years, expiring on January 1, 1992, upon giving to Lessor written notice of intention to review at least ninety [90] days prior to January 1, 1982. Lessee agrees to seed in grass and make into a public park and recreation area the above described land and is given the right and privilege of landscaping and erecting such fixtures and facilities and improvements as will be helpful or necessary for playground and recreation purposes; and it is expressly understood and agreed that any and all such fixtures and faci- lities as may be erected by the Lessee may be removed by the Lessee at the termination of this amended lease Such land- scaping and improvements and fixtures as may be left on the premises at the termination of this amended lease shall become 4 the exclusive property of the Lessor Lessee shall have the privilege of grading said grounds where required, not, however, to the damage or danger of the remaining portion of the area occupied by Lessor, and to otherwise improve the premises The Lessor assumes no responsibility for the con- dition of the premises, and the Lessee expressly agrees to keep the premises insured at all times during its possession thereof so as to protect the public from any liability which may be in- curred by reason of the use or operation of the land and facilities and improvements placed thereon by Lessee Lessee further cove- nants and agrees to save and hold harmless the Lessor from all claims or demands arising out of or by reason of such use Lessee further agrees to pay general taxes, if any, levied against the property herein described during the term of this amended lease There is attached hereto and made a part hereof by reference a plat generally designating the proposed development of the land hereby leased to be included in said park Upon execution of this Amended Lease Agreement, that certain Lease Agreement entered into on October 26, 1970, by and between the parties hereto concerning the same leased premises shall be deemed terminated and cancelled and each party shall be released from all obligation thereunder.
