HomeMy WebLinkAbout12003RESOLUTION NO. 12003 A RESOLUTION TRANSFERRING $30,000 FROM THE 1992- 2011 SALES AND USE TAX CAPITAL IMPROVEMENT PROJECTS FUND FOR DESIGN OF A SHELL BUILDING, PROJECT NO. ED1001 PEDCO PROJECT WHEREAS, pursuant to Ordinances No. 5668 and 5978 adopted by the registered electors of the City of Pueblo, City Council was authorized to establish criteria, standards, rules and regulations for the appropriation and expenditure of funds from the 1992-2011 Sales and Use Tax Capital Improvement Projects Fund (the "Fund") for primary job-creating capital improvement projects; and WHEREAS, pursuant to such authority, City Council adopted Ordinances No. 6381, 7583 and 7836 establishing such regulations and criteria (the "Standards and Criteria"); and WHEREAS, pursuant to the Standards and Criteria, City Council is authorized to make expenditures from the Fund for the construction of shell buildings or for the remodeling or renovation of existing buildings for the purposes of making them available to applicants who meet the Standards and Criteria; and WHEREAS, the Council finds there is a need to construct a shell building within the central core of the City, and in connection therewith, to undertake conceptual and preliminary design thereof to meet the needs of applicants who meet the Standards and Criteria; and WHEREAS, the Pueblo Economic Development Corporation, a Colorado Nonprofit Corporation ("PEDCO") is willing and able to contract for professional design services for the conceptual and preliminary design of the shell building; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Funds in the amount of $30,000 are hereby authorized to be transferred to Project No. ED1001 and expended and made available to PEDCO out of the Fund for the sole purpose of providing or contracting for professional design services for the conceptual and preliminary design of a shell building in the central core of the City. The funds authorized to be transferred and expended shall be released and paid by the Director of Finance to or for the benefit of PEDCO after receipt by the Director of Finance of written requests for payment with documentation that PEDCO has extended funds for such professional services. SECTION 2. In any contract entered into by PEDCO for the professional design services contemplated herein, PEDCO shall provide that the plans and work product produced shall be freely assignable to the City and upon assignment shall become the sole property of the City. SECTION 3. The officers and employees of the City are directed and authorized to perform any and all acts consistent with this Resolution which may be necessary and required to effectuate the design services for the shell building. SECTION 4. This Resolution shall become effective upon passage and approval. ED1001 PEDCO PROJECT ISSUE Should City Council transfer $30,000 from the 1992-2011 Sales and Use Tax Capital Improvement Projects Fund (the "Fund") for conceptual design of a shell building in the core of the City? RECOMMENDATION PEDCO recommends approval. BACKGROUND PEDCO is working with one or more prospects who require a facility in the downtown core of City. This Resolution authorizes transfer of $30,000 to Project No. ED1001 PEDCO Project for professional services for the conceptual/preliminary design of a shell building, which is an authorized use of the Fund. FINANCIAL IMPACT This Resolution will obligate $30,000 from the Fund.
