A RESOLUTION APPROVING AN ADDENDUM TO THE
AGREEMENT BETWEEN POSADA, INC., AS
CONTRACTOR AND THE CITY OF PUEBLO, A
MUNICIPAL CORPORATION, AND AUTHORIZING THE
PRESIDENT OF THE CITY COUNCIL TO EXECUTE SAME
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The First Addendum dated October 12, 2010 to the March 24, 2008 Agreement
for Tenant-Based Rental Assistance Program Services between Posada Inc., and the
City of Pueblo, a Municipal Corporation, (the “Agreement”), for the case management
associated with the tenant based rental assistance program for homeless families or
individuals, a copy of which is attached and incorporated herein, having been approved
as to form by the City Attorney, is hereby approved.
SECTION 2.
The President of the City Council is hereby authorized to execute the Agreement
in the name of the City, and the City Clerk is directed to affix the seal of the City thereto
and attest the same.

ISSUE
Shall City Council approve an addendum to the March 24, 2008 Agreement for Tenant-Based
Rental Assistance Program Services that increases the program funding to Posada?
RECOMMENDATION
Approval of the Resolution
BACKGROUND
In March of 2008, the City of Pueblo entered into a sub recipient agreement with Posada, Inc.,
to administer the Tenant Based Rental Assistance Program. Under the Agreement the City
provided $225,000 in HOME funds for tenant-based rental assistance for the 2007-2008 and
2008-2009 grant years, to include no more than $25,000 in operating costs for the two years
($12,500 per year).
In 2009, the City Council approved an additional $100,000 for Tenant Based Rental Assistance
from the 2009-2010 HOME Investment Partnership Act grant. Posada has spent the 2007-2008
and 2008-2009 funding and is ready to continue providing assistance with the 2009 funding.
Posada has assisted over 30 families through the Program, which provides case management,
with job training, credit counseling, and other life skills components.
The Addendum modifies the Agreement as follows:
1- Increases the total aggregate disbursements under the Agreement from $225,000 to
$337,000 by (a) increasing the maximum funding amount for rental assistance from
$200,000 to a total of $300,000; and (b) increasing the available funds for operating
costs from $25,000 to $37,000, by providing an additional $12,000 in operating funds.
2- Extends the term of the Agreement to December 31, 2011.
3- Makes these modifications effective as of January 1, 2010.
FINANCIAL IMPACT
Funding is available in the 251 Fund, HO0910 and HO0960.
FIRST ADDENDUM TO
AGREEMENT FOR TENANT -BASED RENTAL ASSISTANCE PROGRAM SERVICES
THIS FIRST ADDENDUM to the March 24, 2008 Agreement for Tenant -Based Rental
Assistance Program Services is made and entered into this 12 day of October, 2010 by and
between the City of Pueblo, a Municipal Corporation (hereinafter referred to as "City ") and Posada,
Inc., a Colorado Non - Profit Corporation (hereinafter referred to as "Contractor ")
WHEREAS, Contractor and City have heretofore entered into anAgreement dated March
24, 2008 (hereinafter "the Agreement ") wherein Contractor agreed to offer on behalf of the City a
Tenant -Based Rental Assistance Program in accordance with the terms of that Agreement, the
City's housing strategy and the requirements of law, including but not limited to the HOME
Investment Partnerships Act, 42 U S C §12701 et seq , and implementing regulations, including but
not limited to those at 24 CFR Part 92 205(a)(1) and 92 216 and
WHEREAS, it is necessary and desirable that the Agreement be modified to extend its term,
WHEREAS, it is necessary and desirable that the Agreement be modified to provide for an
additional $100,000 in rental assistance funding and $12,000 in operating funds, subject to all terms
and conditions of the Agreement~
NOW, THEREFORE, in consideration of the foregoing and the mutual terms and conditions
set forth herein, The Agreement is hereby modified as follows
1 Subject to, and contingent upon Contractor complying with all requirements of the
Agreement , and subject to the availability of HOME funds for the Program, City agrees to pay
contractor an additional One Hundred Thousand Dollars (U S $100,000) for tenant -based rental
assistance
2 Subject to, and contingent upon Contractor complying with all requirements of the
Agreement, and subject to the availability of HOME funds for the Program, City agrees to pay
contractor up an additional Twelve Thousand Dollars (U S $12,000) for reimbursement of eligible
Program expenses
3 The aggregate of all payments made pursuant to the Agreement, as hereby modified,
shall not exceed Three Hundred Thirty -Seven Thousand Dollars (U S $337,000)
3 The Term of the Agreement shall be extended to December 31, 2011 unless
terminated sooner as provided in the Agreement
4 This First Addendum and all funding extended hereby shall be effective as of
January 1, 2010
5 Except as expressly modified by this First Addendum, all terms of the Agreement
shall remain in full force and effect. By this First Addendum, the parties do not waive or excuse any
obligations either may have under the Agreement. The Agreement together with this First
Addendum constitute the entire and complete agreement of the parties and supersede all prior
written and oral agreements, understandings, or representations
IN WITNESS WHEREOF, Contractor and City have executed this First Addendum to the
March 24, 2008 Agreement for Tenant -Based Rental Assistance Program Services as of the date
first above written
