AN ORDINANCE BUDGETING AND APPROPRIATING
FUNDS IN THE AMOUNT OF $18,966 FOR GRAFFITI
CONTROL AND REMOVAL
WHEREAS, Section 3-5 of the Charter of the City of Pueblo provides that the
amount by which any fine exceeds three hundred dollars ($300.00) is dedicated to
graffiti control and removal and other law enforcement activities as determined by the
Council; and
WHEREAS, as of August 17, 2010, the aggregate amount of such fines collected
in excess of three hundred dollars ($300.00) is $18,966; and
WHEREAS, the Municipal Court Graffiti Removal/Community Service Program
needs to replace and acquire vehicles, equipment and supplies to carry out graffiti
removal related services. NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The amount of $18,966 in fines collected in excess of three hundred dollars
($300.00) is hereby budgeted and appropriated for acquisition of vehicles, equipment
and supplies for graffiti removal.
SECTION 2.
This Ordinance shall be effective immediately upon passage and approval.

ISSUE
Should funds in the amount of $18,966 be budgeted and appropriated for graffiti control
and removal?
RECOMMENDATION
Approval of the Ordinance.
BACKGROUND
Section 3-5 of the Charter of the City of Pueblo provides that the amount by which any
fine exceeds $300 is dedicated to graffiti control and removal and other law
enforcement activities as determined by the Council.
As of August 17, 2010, the aggregate amount of such fines collected in excess of three
hundred dollars ($300.00) is $18,966.
The Municipal Court Graffiti Removal/Community Service Program’s requests for
services continue to increase, the requests for participation continue to increase, and
the vehicles, equipment, and supplies to carry out graffiti removal related services are
becoming depleted (vehicle, equipment, and supplies). Municipal Court is requesting
that the accrued funds be appropriated for replacement and acquisition of vehicles,
equipment and supplies for graffiti removal.
FINANCIAL IMPACT
The amount of $18,966 generated by the imposition of fines in excess of three hundred
dollars ($300.00) has been received by the City. This Ordinance will budget and
appropriate the funds so that they can be spent in accordance with Charter Section 3-5.
