A RESOLUTION ACCEPTING CONVEYANCE OF REAL
PROPERTY
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
City Council hereby approves and accepts the conveyance of real property
described in the attached Special Warranty Deed from Mary Ann Brady.
SECTION 2.
This Resolution shall become effective upon final passage and approval.

ISSUE
Should the City accept conveyance of approximately 1-1/2 acres of donated property?
RECOMMENDATION
Staff recommends approval.
BACKGROUND
Ms. Mary Ann Brady wishes to donate approximately 1-1/2 acres of land in East Pueblo
Heights Subdivision to the City of Pueblo for future City use. The land is located near
existing City-owned parcels east of Troy and north of U.S. Highway 50 Bypass. The
property is valued at $17,250.
FINANCIAL IMPACT
The City has paid for an appraisal of the property and will pay for title insurance,
aggregating to $1460, which will be paid from the Law Department budget.

SPECIAL WARRANTY DEED
THIS SPECIAL WARRANTY DEED, made this 33r day of September, 2010, between
MARY ANN BRADY, Grantor, who legal address is 14 Villa Drive, Pueblo, CO, 81001, and
Pueblo, a municipal corporation organized and existing under and by virtue of the constitution and
laws of the State of Colorado, Grantee,
WITNESSETH, That the Grantor, for and in consideration of the sum of Ten Dollars and
other good and valuable consideration, the receipt and sufficiency of which are hereby
acknowledged, has granted, bargained, sold and conveyed, and by these presents does grant, bargain,
sell, convey and confirm unto the Grantee, its successors and assigns forever, all of the following real
property in the County of Pueblo and State of Colorado, to wit
Parcel I
Lots 1 to 8, inclusive, and Lots 21 to 28, inclusive, Block 128, East Pueblo Heights
Subdivision, Second Filing, County of Pueblo, State of Colorado
Parcel II
Lots 21 to 29, inclusive, Block 118, East Pueblo Heights Subdivision, Second Filing,
County of Pueblo, State of Colorado
Together with all and singular the hereditaments and appurtenances thereunto belonging, or in
anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and
profits thereof; and all the estate, right, title, interest, claim and demand whatsoever, of the said
Grantor, either in law or equity, of, in and to the above bargained premises, with the hereditaments
and appurtenances, TO HAVE AND TO HOLD the said premises above bargained and described,
with the appurtenances, unto the said Grantee, its successors and assigns forever, subject to
easements, covenants, conditions, restrictions and reservations of record, apparent easements,
general taxes for the year of conveyance and subsequent taxes and assessments, and, burdens
incident to the real property's inclusion within any governmental entity
And the said Grantor shall WARRANT AND FOREVER DEFEND the above bargained
premises in the quiet and peaceable possession of the Grantee and its successors and assigns, against
all and every person or persons lawfully claiming or to claim the whole or any part thereof, by,
through or under the said Grantor
