AN ORDINANCE APPROVING A SPECIAL AREA PLAN

WHEREAS, a request for a Special Area Plan Amendment for Laredo at _=
Parkside, A Special Area Plan, has been submitted to the Planning and Zoning
Commission for approval pursuant to Section 17 -4 -29 of the Pueblo Municipal Code, alE

All of Lot 8 in Block 1 of Laredo at Parkside, A Special Area Plan as recorded at
Reception No. 1414302 in the County of Pueblo, State of Colorado filed for record
December 3 2001 with the Pueblo County Clerk and Recorder.
Containing 3,675 square feet more or Tess
attached hereto, is hereby approved.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval.

AN ORDINANCE APPROVING A SPECIAL AREA PLAN AMENDMENT FOR LAREDO
AT PARKSIDE, A SPECIAL AREA PLAN
ISSUE
Shall City Council approve the Special Area Plan Amendment that will extend the
existing building envelope by two-feet to the west?
RECOMMENDATION
The Planning and Zoning Commission, at their July 14, 2010 Regular Meeting, voted 6-
0 to recommend approval.
BACKGROUND
Laredo at Parkside, a Special Area Plan was developed as a high density single-family
residential subdivision in which houses were constructed adjacent to the property lines.
The approved Special Area Plan facilitated “unique” residential development allowing
greater lot coverage and reduced setback requirements that would not otherwise be
allowed within the R-4 Zone District. Ten-foot easements were platted on each lot for
maintenance, storm drainage and utility lines. The 10-foot easement is split between a
5-foot Drainage and Public Utility easement and a 5-foot Maintenance easement
The single-family residence located at 2108 Toronto Street was constructed two feet
outside of the building envelope encroaching on the Drainage and Public Utility
easement. The applicant is requesting to vacate a portion of the easement and amend
the Special Area Plan to extend the building envelope two-feet west in order to
accommodate the existing structure and to facilitate the sale of the home. Staff has
reviewed the request and does not have an objection to the easement vacation and
Special Area Plan Amendment. Adequate space exists for drainage and maintenance
of the adjacent home. No utilities are located within the two-foot section to be vacated.
