AN ORDINANCE VACATING THE EASTERLY TWO FEET
OF THE 10 -FOOT DRAINAGE AND PUBLIC UTILITY
EASEMENT IN LOT 8, BLOCK 1, LAREDO AT PARKSIDE,
A SPECIAL AREA PLAN
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described easement:
The easterly 2 feet of the 10' Drainage and Public Utility Easement located
in Lot 8, Block 1 of Laredo at Parkside, a Special Area Plan according to
the recorded plat thereof as filed for record at Reception No. 1414302 in
the Pueblo County Records.
is hereby vacated.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval. _

ISSUE
Shall City Council approve the proposed vacation of the easterly 2-feet of the 10-foot
Drainage and Public Utility Easements located within Lot 8, Block 1, Laredo at Parkside,
a Special Area Plan?
RECOMMENDATION
The Planning and Zoning Commission, at their July 14, 2010 Regular Meeting, voted 6-
0 to recommend approval.
BACKGROUND
Laredo at Parkside, a Special Area Plan was developed as a high density single-family
residential subdivision in which houses were constructed adjacent to the property lines.
Ten-foot easements were platted on each lot for maintenance, storm drainage and utility
lines. The 10-foot easement is split between a 5-foot Drainage and Public Utility
easement and a 5-foot Maintenance easement.
The single-family residence located at 2108 Toronto Street was constructed two feet
outside of the building envelope encroaching on the 10-foot easement. The applicant is
requesting to vacate a portion of the easement and amend the Special Area Plan to
extend the building envelope two-feet west in order to accommodate the existing
structure and to facilitate the sale of the home. Staff has reviewed the request and does
not have an objection to the easement vacation. Adequate space exists for drainage
and maintenance of the adjacent home. No utilities are located within the two-foot
section to be vacated.
FINANCIAL IMPACT
None.
