HomeMy WebLinkAbout11964RESOLUTION NO. 11964 A RESOLUTION INCREASING FEES FOR MEDICAL MARIJUANA FACILITY LICENSES BY ADDING POLICE DEPARTMENT POST-LICENSURE FEES AND ESTABLISHING POLICE DEPARTMENT FEES FOR PRE- LICENSURE INSPECTIONS WHEREAS, Sec. 11-10-304(b) of the Pueblo Municipal Code, as amended, provides that the City Council may approve increases or decreases in the fees for licensing medical marijuana facilities by resolution; WHEREAS, the Pueblo Police Department has completed calculating its post- licensure costs for inspecting, monitoring and surveilling the activities of medical marijuana facilities on an annual basis, which warrants an increase in the licensing fees; and WHEREAS, Sec. 11-10-304(c) provide that applicants shall pay the reasonable costs of inspections; and WHEREAS, the police department has established a fee for the pre-licensure inspections. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. The fees set forth in Sec. 11-10-304(a) of the Pueblo Municipal Code, as amended, are hereby increased as provided in Sec. 11-10-304(b) as follows: (1) Application Packet for New License (which shall be credited against the application fee if a complete application is submitted): Twenty-Five Dollars ($25). (2) Application for New License: (a) Medical Marijuana Center License: Six Thousand Sixty-Nine Dollars ($6,069). (b) Marijuana Infused Products Manufacturing Operation License: (if the proposed licensed premises are contiguous to the premises for a Medical Marijuana Center and the application is submitted, accepted, processed and heard at the same time as the application for a Medical Marijuana Center License): Zero Dollars ($0). (c) Marijuana Infused Products Manufacturing Operation License: (if the proposed licensed premises are not contiguous to the premises for a Medical Marijuana Center or the application is not submitted, accepted, processed and heard at the same time as the application for a Medical Marijuana Center License): Six Thousand Sixty- Nine Dollars ($6,069). (d) Optional Premises Cultivation License (if the proposed licensed premises are contiguous to the premises for a Medical Marijuana Center and the application is submitted, accepted, processed and heard at the same time as an application for a Medical Marijuana Center License or Marijuana Infused Products Manufacturing License): Zero Dollars ($0). (e) Optional Premises Cultivation License (if the proposed licensed premises are not contiguous to the premises for a Medical Marijuana Center or the application is not submitted, accepted, processed and heard at the same time as the application for a Medical Marijuana Center License): Six Thousand Sixty-Nine Dollars ($6,069). (3) Application for Renewal of License: Four Thousand Two Hundred Eighty-One Dollars ($4,281). (4) Application for Transfer of Location: One Thousand Seven Hundred Fifty Dollars ($1,750). (5) Application for Change of Principals or Ownership: Three Hundred Dollars ($300). (6) Application for Change in Operational Plan: Three Hundred Dollars ($300). (7) Registration of Manager: One Hundred Dollars ($100). (8) Application for Modification of Premises: Four Hundred Dollars ($400). (9) Report of Minor Change: One Hundred Dollars ($100). (10) Late Renewal Fee: Five Hundred Dollars ($500). (11) License Extension Fee: One Hundred Fifty Dollars ($150) for each thirty (30) day period or portion thereof. SECTION 2. Police Department fees for pre-licensure on-site inspections of proposed medical marijuana facilities shall be: Three Hundred Thirty-Three Dollars ($333). SECTION 3. This Resolution shall become effective upon final passage and approval. Florczak, City Attorney TITLE A RESOLUTION INCREASING FEES FOR MEDICAL MARIJUANA FACILITY LICENSES BY ADDING POLICE DEPARTMENT POST-LICENSURE FEES AND ESTABLISHING POLICE DEPARTMENT FEES FOR PRE-LICENSURE INSPECTIONS ISSUES Should the fees initially established in Sec. 11-10-304(a) of the Pueblo Municipal Code, as amended, be increased (by adding Police Department post-licensure fees), as provided in Sec. 11-10-304(b)? Should a police department fee for pre-licensure on-site inspections be established? RECOMMENDATION Approve the resolution increasing said fees. BACKGROUND The Pueblo Police Department has completed calculating its annual costs for pre- and post-licensure inspection, monitoring and surveillance of medical marijuana facilities. These costs should be added to the costs already established by ordinance for licensing medical marijuana facilities. FINANCIAL IMPACT The increased fees will off-set Police Department costs for inspecting, monitoring and surveilling medical marijuana facilities.
