AN ORDINANCE APPROVING A SPECIAL AREA PLAN
FOR BELMONT SQUARE SHOPPING CENTER, A
SPECIAL AREA PLAN
WHEREAS, a request for a Special Area Plan for Belmont Square Shopping —
Center Subdivision, A Special Area Plan, has been submitted to the Planning and
Zoning Commission for approval pursuant to Section 17 -4 -29 of the Pueblo Municipal
Code, and

A parcel of land being a portion of Parcel "A" of Belmont Thirteenth Filing, according to 1
the Plat thereof recorded February 15, 1956 at Reception No 7280 of the records of the `—
Office of Clerk and Recorder of Pueblo County, Colorado, AND a portion of Parcel "C" %." L
of Belmont Seventeenth Filing, according to the Plat thereof recorded February 27,
1958 at Reception No 63751 of said records, and being more particularly described as
follows Beginning at the Northernmost corner of Lot 1, Block 7, Belmont, Second Filing,
according to the Plat thereof recorded June 5, 1952 at Reception No 914208 of said
records, Thence Southwesterly, along the Westerly boundary line of said Belmont,
Second Filing, the following two (2) courses

TITLE
AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR BELMONT SQUARE
SHOPPING CENTER, A SPECIAL AREA PLAN
ISSUE
Shall City Council approve the Special Area Plan to allow for the unique development of the
Belmont Square Shopping Center Subdivision within the existing Belmont Shopping Center?
RECOMMENDATION
The Planning and Zoning Commission, at their May 12, 2010 Regular Meeting, voted 6-0 to
recommend approval.
BACKGROUND
As proposed, Lot 2 does not meet the B-4 Zone District lot width requirements and Lot 7, is not
located adjacent to a public right-of-way; because of this a Special Area Plan has been filed to
make the proposed development feasible. The Special Area Plan will allow all periphery lots to
share internal access, parking, and utilities with the larger shopping center. Access to Lot 7 is
guaranteed by the proposed Declaration of Reciprocal Easements and the Special Area Plan.
Landscaping of the Lot 6 parking areas and adjacent to rights-of-ways will be phased with
development on Lots 5 and 7. As part of the commercial review process for Lot 7, the
applicants must submit a landscaping plan for the western portion of the Lot 6 parking area and
for the areas adjacent to Bonforte Boulevard (located in Lot 1). Development of Lot 5 will
require a landscaping plan for the north eastern portion of the Lot 6 parking lot and areas
adjacent to Constitution road. All landscaping plans for the Lot 6 parking area and buffer areas
(adjacent to Bonforte Boulevard and Constitution Road) must conform with the Municipal code
and be approved by staff prior to building permit approval. All landscaping improvements must
be made within the specified time limit, found on the plat’s Timing and Improvement Phasing
table.
