ORDINANCE NO 8229
AN ORDINANCE APPROVING A SPECIAL AREA PLAN
FOR BLACK HILLS SUBDIVISION, FILING NO 1, A
SPECIAL AREA PLAN
WHEREAS, a request for a Special Area Plan for Black Hills Subdivision, Filing
No 1, A Special Area Plan, has been submitted to the Planning and Zoning
Commission for approval pursuant to Section 17 -4 -29 of the Pueblo Municipal Code,
and
WHEREAS, the Planning and Zoning Commission after a public hearing found
and determined the objectives and requirements of said Section 17 -4 -29 can and will be
met, and
WHEREAS, the Planning and Zoning Commission has recommended the
approval of the Special Area Plan for Black Hills Subdivision, Filing No 1, A Special
Area Plan,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Special Area Plan for
A parcel of land, located in the N 1/2 of the NW 1/4 of the SE 1/4, and all of the E 1/2 of
the SE 1/4 of Section 10, the SW 1/4 of Section 11, Section 15, the E 1/2 of Section 22,
and the NE 1/4 of Section 27, all being located in Township 20 South, Range 64 West
of the 6th P M , County of Pueblo, State of Colorado, with all the bearings contained
herein based upon a bearing of N88 °01'15 "E, as measured between the W 1/4 Corner
of said Section 10, being marked on the ground by a 3 1/4" aluminum cap on #6 rebar,
PLS 16128, 1989, found in place, and the E 1/4 Corner of said Section 10, being
marked on the ground by an axle, found in place, said parcel being more particularly
described as follows
Beginning at said E 1/4 of Section 10, thence along the East -West centerline of said
Section 11, N89 °08'58 "E, a distance of 2746 60 feet, to the C 1/4 Corner of said Section
11, thence along the North -South centerline of said Section 11, S00 °30'09 "E, a distance
of 2656 10 feet to the S 1/4 of said Section 11, thence along the South line of the SW
1/4 of said Section 11, S88 °53'11 "W, a distance of 2706 81 feet, to the SE Corner of
said Section 10, being marked on the ground by a 3 1/4" aluminum cap on #6 rebar, JR
ENG LTD, PLS 31161, 2000, 20' Witness Corner (West), found in place, thence along
the East line of said Section 15, S01 °21'42 "E, a distance of 2638 63 feet, to the E 1/4
Corner of said Section 15, being marked on the ground by a 3 1/4" aluminum cap on 2"
aluminum pipe, ADAMS & MANGINI, PLS 10093, 1984, found in place, thence
continuing along said East line, S01 °20'56 "E, a distance of 2640 14 feet, to the
Northeast Corner of said Section 22, being marked on the ground by a 3 1/4" aluminum

in place, thence along the East line of said Section 22, S01 °28'38 "E, a distance of
2595 14 feet, to the E 1/4 Corner of said Section 22, being marked on the ground by a 3

feet, to the Northeast Corner of said Section 27, being marked on the ground by a 2"
aluminum cap on #6 rebar, in 1 5'x1 5' concrete pad, MERRICK & CO, PLS 13155,
2005, found in place, thence along the East line of said Section 27, S01 °27'22 "E, a
distance of 1917 02 feet, to a point on the North line of Jimenez Parkway, from where
the E 1/4 Corner of said Section 27, being marked on the ground by a 1" axle, in
1 2'x1 2' concrete pad, with 2" aluminum cap attached, MERRICK & CO, PLS 13155,
2005, found in place, bears S01 °27'22 "E, a distance of 722 42 feet, thence along said
North line, N76 °45'09 "E, a distance of 155 08 feet; thence 150 feet offset West and

attached hereto, is hereby approved
SECTION 2.
The Special Area Plan is approved with the following conditions
1 The Special Area Plan plat must reference the applicable setbacks for development
on the site All setbacks are measured from the property line If a reduced setback
from internal property lines is preferred, make a special note allowing such
development.
2 Provide a very general building envelope that will allow future expansion and
accessory development within the site, or provide specific setback information that
will allow the preferred development.
3 The Special Area Plan Plat must include a note stating that Parcel A will serve as
Public Access to Lots 2 and 3
4 Provide language for use and continuous maintenance of Plant Road
5 Amend the plat title, "Black Hills Subdivision, Filing No 1, A Special Area Plan "
All conditions must be met prior to recording
SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval

ISSUE
Shall City Council approve the Special Area Plan to allow for the unique development of
the Black Hills Annexation Site?
RECOMMENDATION
The Planning and Zoning Commission, at their May 12, 2010 Regular Meeting, voted 6-
0 to recommend approval with the following conditions:
1. The Special Area Plan plat must reference the applicable setbacks for development
on the site. All setbacks are measured from the property line. If a reduced setback
from internal property lines is preferred, make a special note allowing such
development.
2. Provide a very general building envelope that will allow future expansion and
accessory development within the site, or provide specific setback information that
will allow the preferred development.
3. The Special Area Plan Plat must include a note stating that Parcel A will serve as
Public Access to Lots 2 and 3.
4. Provide language for use and continuous maintenance of Plant Road.
5. Amend the plat title, “Black Hills Subdivision, Filing No. 1, A Special Area Plan.”
All conditions must be met prior to recording.
BACKGROUND
The Applicant is requesting approval of a Special Area Plan that will allow the unique
development of the Black Hills Annexation Site. The Special Area Plan and subdivision
include three lots, one parcel and will dedicate the North East Corridor Annexation as
right-o- way, providing access to the power plant site. The purpose of the subdivision is
to facilitate the construction of a 380-megawatt natural gas power plant, which includes
four gas fired turbines, a switchyard and supporting facilities.
Lot 1 is the only lot within the subdivision that fronts a public right-of-way. Therefore, a
Special Area Plan has been developed in conjunction with the subdivision to allow
unique development of the future power plant site. Parcel A is dedicated to Lots 1
through 3, exclusively for access, utilities and drainage. Plant Road is a private road
th
that will connect North 27 Lane to the power plant facilities.
