HomeMy WebLinkAbout08206ORDINANCE NO. 8206 AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO HEIGHT REQUIREMENTS FOR THE HARP-2 AND HARP- 3 ZONE DISTRICTS AND PROVIDING PENALTIES FOR VIOLATION THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscoring indicating matter being added) SECTION 1. Section 17-4-51, Chapter 4, Title XVII of the Pueblo Municipal Code, as amended, is hereby modified by the amendment of subsections (12.3)(e), and (12.3.1)(e) to read as follows: Sec. 17-4-51. Permitted use of land and buildings. . . . (12.3) Historic Arkansas Riverwalk of Pueblo Zone District – Two (HARP 2): . . . e. Performance standards. . . . 4. Structure mass and orientation. Building orientation shall meet the following conditions: a) Roof towers shall not exceed ten percent (10%) of the overall roof area of the structure. b) Minimum height from the Riverwalk level shall be no less than twenty-five (25) feet or two (2) times the gross floor area of the building footprint, whichever is more. Maximum height shall be determined by the Planning c) and Zoning Commission at the time of Site Plan Review. d) Each building shall provide full access to the Riverwalk and to the closest street right-of-way. . . . This Ordinance and these amendments to Title XVII of the Pueblo Municipal Code shall be subject to administration and enforcement in accordance with Chapters 5 and 7 of Title XVII, Pueblo Municipal Code, as amended. Any person who violates any provision of this Ordinance or these amendments shall be guilty of a municipal offense and subject to punishment and all other remedies as provided in Chapter 7 of Title XVII of the Pueblo Municipal Code, as amended. SECTION 3. This Ordinance shall become effective immediately upon final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO HEIGHT REQUIREMENTS FOR THE HARP-2 AND HARP-3 ZONE DISTRICTS AND PROVIDING PENALTIES FOR VIOLATION THEREOF ISSUE Should the City Council amend Chapter 4 of Title XVII of the Pueblo Municipal Code relating to Height Requirements for the HARP-2 and HARP-3 Zone Districts? RECOMMENDATION The Planning and Zoning Commission, at their April 14, 2010 Regular Meeting, voted 6- 0 to recommend approval. BACKGROUND Currently, the minimum height requirement for all HARP-3 zoned properties is 55 feet or five stories, whichever is more. The proposed text amendment will revise this minimum to be 45 feet or four stories, whichever is more. In addition, the proposed text amendment will add a requirement that the maximum height for HARP-2 and HARP-3 zoned properties will be determined by the Planning and Zoning Commission at the time of site plan review. The intent of this is for the Planning and Zoning Commission to review the proposed construction to determine it’s compatibility with City Hall and the City Hall Cupola. FINANCIAL IMPACT None.
