HomeMy WebLinkAbout08198 ORDINANCE NO. 8198 AN ORDINANCE AMENDING CHAPTER 10 OF TITLE IX, PUEBLO MUNICIPAL CODE, PROHIBITING MEDICAL MARIJUANA CENTERS, OPTIONAL PREMISES CULTIVATION OPERATIONS ASSOCIATED WITH SUCH CENTERS AND MEDICAL MARIJUANA INFUSED PRODUCT MANUFACTURING OPERATIONS WITHIN THE CITY OF PUEBLO, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF BE IT ORDAINED BY THE PEOPLE OF THE CITY OF PUEBLO, that (brackets indicate matter being deleted; underscoring indicates new matter being added): SECTION 1. Chapter 10 of Title IX of the Pueblo Municipal Code is hereby amended by the addition of a new section 9-10-95 thereto to read as follows: Sec. 9-10-95. Medical marijuana facilities prohibited. (a) The City shall not issue a license to any person to operate a medical marijuana center, an optional premises cultivation operation associated with such a center, or a medical marijuana infused product manufacturing operation, as defined in C.R.S. §12-43.3-104, within the City. (b) No person shall operate a medical marijuana center, an optional premises cultivation operation, or a medical marijuana infused product manufacturing operation, as defined in C.R.S. §12-43.3-104, within the City. (c) Violation of this Section shall be a Class 1 municipal offense, punishable by a fine of up to one thousand dollars ($1,000) or one year in jail, or by both such fine and imprisonment. Each day and each facility shall constitute a separate and distinct offense subject to the foregoing penalties. SECTION 2. This Ordinance shall become effective immediately upon majority vote in favor thereof by the eligible electors of the City voting thereon at the special municipal election to be held November 2, 2010. SECTION 3. As of the effective date of this Ordinance, all provisions of the Pueblo Municipal Code and ordinances of the City inconsistent herewith are repealed and shall be void and of no effect.
