HomeMy WebLinkAbout11892RESOLUTION NO. 11892 A RESOLUTION APPROVING A TIME EXTENSION FOR THE COMPLETION OF DEFERRED FILINGS FOR THE PASTORA RANCH SUBDIVISION, FILING NO. 1 WHEREAS, City Council by Ordinance No. 8013 on May 11, 2009, conditionally approved the plat of Pastora Ranch Subdivision, Filing No. 1, with the condition that all deferred filings be filed with and approved by the Director of Public Works within one year from the date the final subdivision plat was conditionally approved by ordinance, unless a time extension is granted by Resolution by the City Council; and WHEREAS, the subdivider has requested a time extension for the submittal and approval of the deferred filings to November 11, 2010; and WHEREAS, the Subdivision Review Committee has reviewed the Subdivider’s request for said time extension and does not object to the request; BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The subdivider of the Pastora Ranch Subdivision, Filing No. 1, is hereby granted a time extension to November 11, 2010, for the submittal and approval by the Director of Public Works of all information, documents, drawings, profiles, and plat required by Chapter 4 of Title XII of the Pueblo Municipal Code. TITLE A RESOLUTION APPROVING A TIME EXTENSION FOR THE COMPLETION OF DEFERRED FILINGS FOR THE PASTORA RANCH SUBDIVISION, FILING NO. 1 ISSUE Should the City Council approve a time extension for the completion of deferred filings for the Pastora Ranch Subdivision, Filing No. 1? RECOMMENDATION Approval of this Resolution. BACKGROUND City Ordinance, Section 12-4-5(b)(2) allows the subdivider to defer the filing of detailed plans and profiles for streets, sanitary sewers, storm sewers and other drainage facilities, off-site easements, covenants and subdivision improvements agreement for up to one (1) year from the date the final subdivision plat is conditionally approved by Ordinance. These are referred to as “deferred filings”. This same section of the Ordinance allows for up to six (6) months time extension with the approval of City Council by Resolution upon request of the Subdivision Review Committee. The subdivider of the Pastora Ranch Subdivision, Filing No. 1, has made such request for time extension and the Subdivision Review Committee has approved this request. FINANCIAL IMPACT None.
