A RESOLUTION AUTHORIZING THE REIMBURSEMENT OF
$31,192.90 FROM INSURANCE PROCEEDS TO NATURE AND
RAPTOR CENTER OF PUEBLO, INC. FOR COSTS INCURRED
TO ERECT A YURT ON PROPERTY OWNED BY THE CITY OF
PUEBLO
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
A City -owned structure located on City -owned property at the Greenway and
Nature Center was destroyed by fire in 2007, and insurance proceeds in the amount of
$186,146.56 to cover the loss of property were issud to and received by the City in April
2007. A portion of the proceeds was used to demolish the damaged structure.

The Nature and Raptor Center of Pueblo, Inc., erected a yurt on the property to
replace the demolished structure at a cost of $31,192.90.

Reimbursement of funds in the amount of $31,192.90 to the Nature and Raptor
Center of Pueblo, Inc. from the insurance proceeds received by the City for the property
loss is hereby approved.
SECTION 4.
Said funds shall be disbursed from special project CP0714 account 401 -0000-
600.79-30.

Should the City Council approve a Resolution to reimburse Nature and Raptor Center of Pueblo,
Inc. (NRC) for costs incurred to erect a yurt to replace a classroom structure on City property
located at the N RC that was destroyed by fire?
RECOMMENDATION:
This resolution is brought forth at the request of Council Member Steve Nawrocki.
BACKGROUND:
In early 2007, a portion of a City -owned structure located at what was then called the Greenway
and Nature Center was destroyed by fire as a result of vandalism. The structure was insured
through CIRSA, and CIRSA deemed the entire building to be a loss. On April 16, 2007, the City
was issued a check for $186,146.56 to cover the entire loss. Of that amount, the City was
required to reimburse CIRSA $25,000 from the self- insurance fund to cover the deductible.
Special project CP0714 was established for the insurance proceeds, and a portion of the funds
were used for the demolition of the building. A balance of $56,461.36 remains in the project
account.
In 2008, the Greenway and Nature Center changed its name to Nature and Raptor Center of
Pueblo. At a cost of $31,192.90, the NRC recently purchased and installed a concrete platform,
ADA accessible ramp, and 30' yurt (tentlike dwelling with a conical roof) to replace the
classroom which was destroyed in the fire. The NRC is requesting reimbursement from the City
to cover costs associated with the yurt and is willing to provide a Bill of Sale granting all right,
title, and interest in the yurt to the City upon reimbursement.
FINANCIAL IMPACT:
$31,192.90 would be used from special project CP0714 account 401 - 0000 - 600.79 -30 to
reimburse the Nature and Raptor Center of Pueblo, Inc.
BILL OF SALE
1, Jay L. Zarr , state that:
1. I am President of Nature and Raptor Center of Pueblo, Inc., a nonprofit
corporation, which is the sole owner of the personal property shown below.
2. I have authority under the Articles of incorporation and bylaws of Nature and
Raptor Center of Pueblo, Inc., a nonprofit corporation, to enter into this transaction and execute
this Bill of Sale, which is in the best interest of Nature and Raptor Center of Pueblo, Inc., a
nonprofit corporation.
The personal property shown below is free and clear of all liens and claims.
4. In consideration of the sum of $31,192.90, the receipt and sufficiency of which is
hereby acknowledged, and on behalf of Nature and Raptor Center of Pueblo, Inc., a non - profit
corporation, I hereby sell and grant to the City of Pueblo, a Municipal Corporation, all right, title
and interest in the following personal property without reservation of any right, title, interest, or
claim to such personal property to Nature and Raptor Center of Pueblo, Inc., a nonprofit
corporation, to myself, or anyone else:
One (1) 30' Basic Yurt Package, including 30' taller wall, duro -last roof,
Astrofoil roof and wall insulation, big wind package, The CORR, perimeter studs,
hurricane clips, double anchors, stove pipe outlet, additional door, screen door, euro -style
dome lifter, tinted bronze dome, and additional window for tall wall yurt; concrete
platform and deck; and ADA accessible ramp presently located on City of Pueblo
property at the Greenway and Nature Center manufactured/purchased from Advance
Canvas Design, LLC, Colorado Yuri Company (Invoice #19132).
