A RESOLUTION ACCEPTING CONVEYANCE OF AN
EASEMENT FROM COLLEGE PARK PARTNERSHIP, A
COLORADO GENERAL PARTNERSHIP
WHEREAS, the owners of College Road Subdivision, 4 t " Filing have granted an
easement for use by the City and public utilities to the City of Pueblo; and
WHEREAS, such easement is necessary to install public utilities.
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Easement granted, a copy of which is attached hereto, having been
approved as to form by the City Attorney, is hereby approved and accepted.

The City Clerk is directed to cause said Easement to be recorded in the office of
the Pueblo County Clerk and Recorder forthwith. The recording fees for this easement
are to be paid for by the grantor.

ISSUE
Should the City Council accept an easement and right of way from College Park
Partnership, a Colorado General Partnership for use by the City and public utilities?
Approval of this Resolution.
BACKGROUND
This easement is necessary to allow for the installation of public utilities within College
Road Subdivision, 4 Filing.

EASEMENT
This Easement is granted on FL- %yWM'' 23 . 2010 by College Park Partnership, a
General Partnership and sole owner, Grantor, to Pueblo a Municipal Corporation, Grantee.
IN CONSIDERATION of Ten Dollars ($10.00) and other good and valuable consideration
paid by the Grantee, receipt of which is hereby acknowledged, Grantor hereby grants to Grantee, its
successors and assigns, a five (5) to ten (10) foot wide easement for Grantee and all public utilities
authorized by franchise or license with Grantee, to install, construct, operate, maintain, replace and
remove public utilities and related appurtenances under and across the property which the Grantor
owns or in which the Grantor has any interest situated in the City of Pueblo, Pueblo County,
Colorado, and described in the attached Exhibits "A" and "B" (the "Property').
TOGETHER WITH the, right of ingress and egress over and across the adjoining lands of
the Grantor to and from the Property for the purpose of exercising its rights herein granted. The
Grantor reserves the right to use and occupy the Property and to grant or convey the right to use and
occupy the Property for any purpose which does not unreasonably interfere with the rights herein
granted.
GRANTEE will not locate, erect or cause to be located or erected any permanent building
or any other above ground structures larger than 4' wide by 4' deep by 4' high upon the Property.
This Easement and the above covenants, terms, conditions and provisions shall be binding
upon and inure to the benefit of the successor and assigns of the Grantor and Grantee.
