A RESOLUTION MAKING LEGISLATIVE FINDINGS THAT
THE UNION AVENUE AREA OF THE CITY OF PUEBLO IS
A BLIGHTED AREA AND APPROPRIATE FOR AN URBAN
RENEWAL PROJECT
WHEREAS, MTA Planning & Architecture (the "Consultant') has been retained
by the Urban Renewal Authority of Pueblo, Colorado (the "Authority ") to conduct studies
and surveys of the area (the "Area ") described in Exhibit A, attached to and
incorporated herein, to determine if the Area contains factors included in the definition of
"blighted area" in the Colorado Urban Renewal Law Sections 31 -25 -101, et seq.,
C.R.S., (the "Act'); and
WHEREAS, the Consultant prepared, submitted and presented to the City
Council a document entitled "Union Avenue Area Conditions Survey" (the "Survey ")
dated March 25, 2009, and updated as of September 18, 2009, which Survey is
incorporated herein by this reference, and which describes in detail the conditions in the
Area that are summarized in Section 1, below. NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Based on a review of the Survey and in accordance with the Act, the City Council
finds and determines that the Area is a "blighted area" as defined in Section 31 -25-
103(2) of the Act, and by reason of the presence of the following factors the Area
substantially impairs or arrests the sound growth of the City, retards the provision of
housing accommodations, constitutes an economic and social liability, and is a menace
to the public health, safety, morals or welfare in its present condition and use. The City
Council finds and determines that the following factors exist in the Area:
a. Slum, deteriorated, or deteriorating structures;
b. Predominance of defective or inadequate street layout;
C. Faulty lot layout in relation to size, adequacy, accessibility, or usefulness;
d. Unsanitary or unsafe conditions;
e. Deterioration of site or other improvements;
f. Inadequate public improvements or utilities;
g. The existence of conditions that endanger life or property by fire and other
causes;
h. Buildings that are unsafe or unhealthy for persons to live or work in
because of building code violations, dilapidation, deterioration, defective
design, physical construction, or faulty or inadequate facilities;
Environmental contamination of buildings or property;
The existence of health, safety, or welfare factors requiring high levels of
municipal services or substantial physical underutilization or vacancy of
sites, buildings, or other improvements.
SECTION 2.
The City Council further finds and determines the Area is appropriate for an
urban renewal project pursuant to the Colorado Urban Renewal Law.
SECTION 3.
This Resolution is effective upon its approval by the City Council.

ISSUE
Should City Council determine the proposed Union Avenue Urban Renewal Project
Area is a blighted area as defined in C.R.S. Section 31 -25- 103(2)?
Approve the Resolution.
BACKGROUND
This Resolution finds the vicinity in and around Union Avenue, from D Street to
Abriendo Avenue, contains blight conditions as defined by C.R.S. 31 -25- 103(2). A
Conditions Survey was conducted by an independent third -party to determine whether
or not the area described above contains conditions of blight. The Conditions Survey
found that ten blight factors exist. Four blight factors are required as a prerequisite to
adoption of an urban renewal plan and establishment of an urban renewal project area.
The ten conditions of blight are outlined below:
• Slum, deteriorated, or deteriorating structures;
• Predominance of defective or inadequate street layout;
• Faulty lot layout in relation to size, adequacy, accessibility or usefulness;
• Unsanitary or unsafe conditions;
• Deterioration of site or other improvements;
• Inadequate public improvements or utilities;
