HomeMy WebLinkAbout11645RESOLUTION NO. 11645 A RESOLUTION AUTHORIZING THE ISSUANCE OF A BUILDING PERMIT AND TEMPORARY CERTIFICATE OF OCCUPANCY FOR 100 TOWERS ROAD PRIOR TO THE RECORDING OF THE VESTAS TOWERS AMERICA SUBDIVISION BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SFrTinN 1 Due to exigent circumstances, contemporaneously with the filing of a complete subdivision application meeting all of the requirements of Chapter 4, Title XII of the Pueblo Municipal Code as determined by the Director of Public Works ( "Subdivision ") for the land located at 100 TOWERS ROAD ( "Property "), the City administration is authorized to approve the issuance of a building permit and temporary certificate of occupancy for a building or structure to be constructed or installed on the Property. SFrTinN 9 The building permit and temporary certificate of occupancy will be deemed revoked and cancelled if the owner of the Property does not diligently pursue the Subdivision to final approval. No final certificate of occupancy shall be issued for any building or structure constructed or installed on the Property pursuant to the Building Permit until after the plat has been recorded. The conditions, restrictions, and limitations set forth herein shall be incorporated in and made a part of the Building Permit. TITLE A RESOLUTION AUTHORIZING THE ISSUANCE OF A BUILDING PERMIT AND TEMPORARY CERTIFICATE OF OCCUPANCY FOR 100 TOWERS ROAD PRIOR TO THE RECORDING OF THE VESTAS TOWERS AMERICA SUBDIVISION ISSUE Should the City Council authorize the issuance of a building permit to PCL Contractors prior to the recording of the subdivision? RECOMMENDATION Approval of this Resolution. BACKGROUND In an effort to expedite construction, a request has been made by Vestas Blades America, Inc. for approval by the City Council to allow staff to sign off on a building permit prior to a recorded subdivision. This resolution will authorize City administration to approve the issuance of a building permit and a temporary certificate of occupancy prior to the recording of the subdivision plat. City Council has approved this subdivision; however, before the plat can be recorded, the developer needs to turn in the Part 2 submittals. Said building permit will be revoked and cancelled if the owner of the property does not diligently pursue the completion of the subdivision process. No final certificate of occupancy shall be issued for any building or structure associated or installed on the property until after the subdivision has been approved by City Council and the plat has been recorded.
