The Memorandum of Understanding between Pueblo City Schools, Spanish
Peaks Mental Health Center, Tenth Judicial Court, Parkview Medical Center, Tenth
Judicial District Office of the District Attorney, Pueblo City County Health Department,
Crossroads Turning Points, Inc. and the City of Pueblo relating to long range
cooperation and administrative planning to provide for the safety and healthy
development of children, a true copy of which is attached hereto, having been approved
as to form by the City Attorney, is hereby approved.
SECTION 2.
The President of the City Council is hereby authorized to execute the
Memorandum of Understanding on behalf of the City of Pueblo Police Department.

AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME
ISSUE
Whether to approve the Memorandum of Understanding relating to long range cooperation
and administrative planning to provide for the safety and healthy development of children.
The department recommends approval of this resolution.
BACKGROUND
This Memorandum of Understanding allows the City of Pueblo to partner with all agencies
listed in the title, to support the implementation and enhancement of integrated,
comprehensive community -wide plans that create safe and drug -free schools and promote
healthy childhood development.
Pueblo City Schools has received the Safe Schools /Healthy Students SS /HS Federal Grant
for 2008 -2012. All agencies agree to work to enhance existing resources and implement
program models, curricula, and services that reflect the mission of providing a healthy, safe,
and engaging environment for the students and families of Pueblo County.
FINANCIAL IMPACT
There is no direct financial cost to the City, however, the MOU anticipates that employees in
the Pueblo Police Department will dedicate time and effort in furtherance of the program.
See Section XI, Page 9, of the MNOU for the 13 commitments for employees in the Pueblo
Police Department.
FINAL MEMORANDUM OF UNDERSTANDING (MOU)
Safe Schools/ Healthy Students
Pueblo City Schools 2008 -2012
This Agreement is made by and among the PUEBLO SCHOOL DISTRICT # 60
A.K.A. PUEBLO CITY SCHOOLS (PCS) and hereafter identified as PCS in this
Agreement, located at 315 W. I I th Street, Pueblo, CO 81003; the SPANISH PEAKS
MENTAL HEALTH CENTER, located at 1026 W. Abriendo Avenue, Pueblo, CO
81004; the TENTH JUDICIAL COURT, located at 320 W 10` Pueblo, CO 81003; the
CITY OF PUEBLO ( "Pueblo ") for purposes of this agreement, located at 130 Main
Street, Pueblo, CO 81003; the PARKVIEW MEDICAL CENTER, located at 400 W.
10 Street, Pueblo, CO 81003; The OFFICE OF THE DISTRICT ATTORNEY,
TENTH JUDICIAL DISTRICT, COLORADO, BILL THIEBAUT, DISTRICT
ATTORNEY, 701 Court Street, Pueblo, Colorado 81003; the PUEBLO CITY
COUNTY HEALTH DEPARTMENT, located at 151 Central Main, Pueblo, CO

WHEREAS, the City of Pueblo, Colorado has a population of approximately 106,000 and
multiple service agencies including public and private sectors, non -profit service
providers, and faith -based communities that provide mental and physical health services,
public health services, substance abuse services, juvenile justice, public protection
services, social services, and educational services; and,
WHEREAS, these service agencies often share overlapping missions as well as clientele
and desire to maximize their effectiveness and use of resources; and,
WHEREAS, numerous programs and community partnerships are already in place to
address the challenges faced by families and youth; and,
WHEREAS, the City of Pueblo has one school district, Pueblo City Schools District 60
(PCS) serving approximately 18,000 students; and
WHEREAS, the SS /HS program is in alignment with and supportive of the Pueblo City
Schools Strategic Plan; and
WHEREAS, Pueblo City Schools and its partners recognize the paramount importance of
a safe environment and good physical, mental and emotional health to the academic and
life success of its students; and,
WHEREAS, all partner agencies to this MOU desire a maximum degree of long range
cooperation and administrative planning in order to provide for the safety and healthy
development of children; and,

WHEREAS, all agencies are committed to improving services to children in the schools,
community, county and courts through sharing information, eliminating duplication of
services and coordinating efforts; and,
WHEREAS, all partner agencies mutually agree that sharing resources, where feasible,
and in particular training efforts, may result in improved coordination; and,
WHEREAS, all partner agencies have certain roles in serving youth and families which
are required by law and these laws serve as the foundation for defining the role and
responsibility of each participating agency; and,
WHEREAS, all partner agencies mutually agree that provisions in this MOU shall be
interpreted in light of, and consistent with governing local, state and federal laws; and,
WHEREAS, Pueblo City Schools is the recipient of the Safe Schools/ Healthy Students
SS /HS Federal Grant for 2008 -2012; and,
WHEREAS, the purpose of the SS/HS program is to support the implementation and
enhancement of integrated, comprehensive community -wide plans that create safe and
drug -free schools and promote healthy childhood development;
NOW THEREFORE, BE IT RESOLVED BY THE PARTNER AGENCIES THAT THEY
SUPPORT THE MISSION STATEMENT SET FORTH BELOW AND AGREE TO
COLLABORATE IN THE FOLLOWING MATTERS SET FORTH IN THIS MOU:
I. Mission Statement
Pueblo City Schools (PCS) Safe Schools and Healthy Student Project will support
and strengthen the district's relationship with the Spanish Peaks Mental Health
Center; the Tenth Judicial Court; Pueblo; Parkview Medical Center; Office of the
District Attorney, Tenth Judicial District; Pueblo City County Health Department;
and, Crossroads Turning Points, Inc., as they work to enhance existing resources and
implement program models, curricula, and services that reflect Pueblo City Schools
mission of providing a healthy, safe, and engaging environment for the students and
families of Pueblo County.
II. Program Priority
The overarching priority of the SS /HS program is implement an integrated,
comprehensive community -wide plan designed to create safe, respectful, and drug
free school environments and promote pro - social skills and healthy childhood
development.
III. Grant Elements:
Activities, curricula, programs, and services of the SS/HS program must focus on and
address the community's needs, gaps, or weaknesses in the areas related to these five
comprehensive plan elements.

Safe School Environments and Violence Prevention Activities.

Alcohol, Tobacco, and Other Drug Prevention Activities.

Element Three:
Student Behavioral, Social and Emotional Supports.

Early Childhood Social and Emotional Learning Programs.
IV. Goals of the Partnership
To create systems of change to ensure that PCS and the Pueblo Community provide a
safe, healthy and engaging environment for all PCS students and families and
promote healthy childhood development. Collective resources will be used to
accomplish the following goals:
• Goal l: Provide a safe, orderly, and pro - social school environment where
students can optimize their academic achievement.
• Goal 2: Reduce the use of ATOD in PCS prevention, intervention and treatment
strategies.
• Goal 3: Reduce the number of students who engage in negative behaviors that
impact their abilities to stay in school.
• Goal 4: Reduce the number of PCS students for whom mental health issues
prevent health, happiness and academic success.
• Goal 5: Promote pro - social skills for healthy childhood development that results
in increased academic engagement and school readiness.
V. Pueblo City Schools SS /HS Management Structure:
Pueblo City Schools- Board of Education- Pueblo City Schools (PCS) is the lead
agency for this SS /HS Initiative. The Pueblo City Schools Board of Education is the
policy - making body of the school district. The Board is responsible for educational
planning and evaluation, staffing and appraisal, school facilities, financial resources
and communication. The Board, whose powers and duties are set by state law, acts as
a court of appeal for staff members, students and the public on issues involving board
policy or implementation of that policy.
Superintendent- The Pueblo City Schools' Superintendent of Schools, reporting to
the Board of Education, provides administrative leadership to the public school
district. The superintendent is primarily responsible for administering the policies of
the Board of Education. The superintendent's responsibilities include overseeing a
strategic plan, managing the budget, driving a comprehensive curriculum to
international standards, building and strengthening relationships with parents and
community and representing the school district as the primary spokesperson.
Chief Officer of Student Support and Community Services- The Chief Officer of
Student Support and Community Services provides administrative leadership for the

Division of Student Support and Community Services and specifically the PCS
Department of Social Services. The Chief Officer reports to the Superintendent.
Executive Director- Coordinated School Health/Social Services- The Executive
Director for Coordinated School Health/ Social Services provides administrative
leadership for all health - related programs throughout the district and directly
supervises the Project Director for the SS /HS Program.
Project Director- Pueblo City Schools is the lead agency, employing the Project
Director and key project staff. The SS /HS Project Director is responsible for
providing leadership and management to the SS /HS Initiative and will ensure that the
SS /HS grant expectations are fulfilled.
VI. SS /HS Core Management Team (CMT)
The SS /HS Core Management Team (CMT) comprised of key decision makers from
Pueblo City Schools, Spanish Peaks Mental Health Center; the Tenth Judicial Court;
the Pueblo Police Department; Parkview Medical Center; Office of the District
Attorney, Tenth Judicial District;, the Pueblo City County Health Department; and,
Crossroads Turning Points, Inc. is responsible for the governance and oversight of the
SS/HS grant. The CMT will provide the primary means of communication,
networking, resource sharing among project partners and direct support to the SSMS
Project Director.
VII. Selection of Core Management Team
The PCS SS /HS Initiative strives to build partnerships including the Core
Management team that share common missions and visions for providing a healthy,
safe, and engaging environment for the students and families of Pueblo County.
Specifically, these partners were selected to participate in the SS /HS initiative
because:
Spanish Peaks Mental Health is the Local Mental Health Authority and has
been actively involved with PCS as a reliable referral source, participates as a
member of the PCS crisis management team, parent support teams, student
placement committees and various other advisory committee's for PCS.
Tenth Judicial District Combined Courts maintains an active MOU with PCS
to provide assistance in school attendance and to Project Respect by ordering
student participation in agency programs for mental health, parenting classes
and family therapy.
Pueblo has a current contract with PCS supporting School Resource Officers
(SROs) and Community Oriented Policing Services (COPS) programs and
activities subject to the terms and conditions of such contract. SRO and
COPS Officers are integral members of the district safe schools committee
and on other community student based committees. Nothing contained in the
Agreement shall be or be construed to be a commitment by Pueblo to continue
such contract with PCS beyond the current fiscal year.

• Parkview Medical Center and PCS have had a successful twelve year
partnership with an active MOU in co- sponsoring four School -Based
Wellness Centers located in the Pueblo school district. Students have
generated over 150,000 visits to the centers since they were open in 1995.
• Office of the District Attorney, Tenth Judicial District, is an active partner in
facilitating gang prevention, restorative justice, and safe communities
programs.
• Crossroads Turning Points facilitates monthly community meetings for
Colorado Prevention Partners Pueblo Policy Board. They work directly with
PCS Office of Social Services to manage the Colorado Prevention Partners
grant, deliver substance abuse prevention activities in the schools and
coordinate targeted after school programs, facilitate and coordinate underage
drinking activities and act as a member on the Health Advisory Council.
• Pueblo City /County Health Department (PCCHD) has a long history of
working closely with the District in providing support and assistance with
administration of various health services, screenings and is the expert advisor
for communicable diseases, sexually transmitted diseases, family planning,
immunizations, emergency preparedness, health education, food safety and
other environmental issues. PCS and PCCHD have an established and strong
partnership through the Steps to a Healthier US initiative. PCCHD is an
integral member of the PCS Health Advisory Council.
VIII. SS /HS Core Management Team Expectations:
CMT members:
1. Promote a coordinated effort among agencies and staff to achieve maximum school
safety with the goal of creating safe and drug -free schools and promoting healthy
family and childhood development; and
2. Commit to the placement of Directors and /or other senior staff representatives
capable of being decision - makers on the SS /HS Core Management Team (CMT) and
regular participation in the CMT meetings;
3. Meet monthly for the first year of the grant and then will meet every other month or
as frequently as the CMT deems appropriate to assure proper oversight of the
program;
4. Address the collective "big picture" of the entire Initiative and do not limit
considerations /concerns to their own agency;
5. Identify areas of need and concern and problem -solve (e.g. team may identify
workgroups to focus on particular components and report back to CMT.);
6. Provide leadership, guidance, troubleshooting and problem- solving and support the
Project Director in managing tasks from start up through implementation and
sustainability;
7. Participate as appropriate in selecting SS /HS staff especially the Project Director and
Evaluator;
S. Report on and review the status of project activities, staffing and capacity issues and
data collection;

9. Actively promote the SS /HS program within the community and identify additional
partners and collaborators essential to the program's success;
10. Assist to identify best practices for implementation by the Project Director;
11. Agree to abide by all the confidentiality provisions required by state and federal law,
including HIPAA regulations;
12. Share information within the boundaries of confidentiality and in compliance with the
Family Education Rights and Privacy Act of 1974, 20 U.S.C. 1232g ( "FERPA ") that
can lend to better care for the student(s) and further success of the initiative in the
community;
13. Participate in information sharing and creation of a multi - agency Authorization for
Release of Information Form pursuant to FERPA and HIPAA;
14. Adhere to agreed upon procedures for referral, treatment and follow -up;
15. Promote culturally competent delivery of project services;
16. Participate and cooperate in all related evaluation activities including sharing of
appropriate organizational data quarterly with the project director and evaluator and
participation in the required national evaluation required by the federal government,
in accordance with the policies of each partner agency;
17. Participate in strategic planning and sustainability planning as deemed appropriate by
the CMT; and
18. Ensure that their respective agencies fulfill their specific responsibilities as defined in
this MOU.
iX. SS /HS Core Management Team Decision Making:
1. CMT decisions will be made by consensus or majority vote of a quorum when
needed.
2. A Quorum is defined as four members of the CMT.
Each Core Management Team partner organizations will each have one vote. The
vote may be cast by either the individual appointed to serve on the CMT or their
designee identified in this MOU.
3. CMT agrees to support and abide to decisions made through consensus or majority
vote.
4. CMT will provide only guidance and input in hiring of core project staff, budget
decisions, and changes to the project/specific programs.
5. CMT will provide guidance /direction in situations where potential conflict of interests
develop related to SS /HS efforts.
6. CMT decision making will be documented and maintained as a record through the
duration of the grant or as required by state and federal laws or applicable local rules
that relate to the SS /HS effort.
7. Special meetings of the CMT as may be required outside of the normal CMT
scheduled meetings shall be held at such time and place as shall be designated by the
Project Director.
8. Each organization may designate more than one individual to participate in the CMT
but each organization has only one vote.
X. PCS Support of CMT

I . Arrange and facilitate monthly meetings for PCS and all SS /HS partners
2. Distribute quarterly reports regarding the progress on this initiative
3. Aggregate and distribute evaluative analysis of all SS/HS objectives of the project for
informed decision making processes.
4. Work with each of the partners to establish data collection and evaluation tools.
5. Provide secretarial support to take meeting notes and prepare notes for CMT review
6. Whenever possible, disseminate meeting agendas and other materials to the CMT
members prior to the meetings.
XI. Individuals appointed by the SS /HS partner agencies to serve on the CMT
Core Management Team- Voting Members
Each Core Management Team partner organizations will each have one vote. The
vote may be cast by either the individual appointed to serve on the CMT or their
designee identified in the following list:

XI. Roles and Responsibilities of each Partner
In order to ensure comprehensive and integrated delivery of programs and services for
the Safe Schools and Healthy Students Project, each partner and future partners in this
initiative commit to the following:
Pueblo City Schools

• Continued membership and active participation in the Pueblo City Schools SS /HS Core
Management Team;
• Provide administrative and fiscal management for this grant project;
• Coordinate activities, evaluations, analysis, and information distribution for this project;
• Hire or contract for appropriate staff to complete the scope of work identified in the grant
proposal;
• Collaborate with SS /HS Partners in policy study, school and community assessment, and
implementation of proposed projects;
• Ensure implementation and fidelity of proposed projects;
• Coordinate and develop professional, student, and family training in conjunction with
trainings provided by SS /HS partnerships;
• Maintain an active Health and Safety Advisory Council whose membership currently
includes a cross section of parents, students and community members who are
demographically representative of the community;
• Provide all data related to the Government Performance and Results Act Performance
Indicators established by the Federal Government for the purposes of the Safe Schools
and Healthy Students Initiative;
• Develop a written RFP for external evaluator
• Contract for an external evaluator
• Insure that Federal guidelines are followed for human subjects research including but not
limited to the implementation of an Institutional Review Board process, completion of
the Federal Wide Assurance (FWA) documentation, and adherence to PPRA, FERPA and
H1PAA.
• Provide evaluation reports to the partners quarterly
• Take a lead role to facilitate sustainability planning for the grant activities.
• Participate in additional grant writing activities to further expand the services offered
and /or to sustain program activities.
Spanish Peaks as the Local Public Mental Health Authority
• Participate fully as a member of the SS /HS Core Management Team;
Provide administrative control and /or oversight of the delivery of mental health services;
Provide a continuum of mental health services to students and families;
■ Ensure the use of established protocol in determining the supervisory role and function of
the Mental Health Coordinator and Mental Health Counselors;
Provide consultation by Child Psychiatrist for medication management;
Share information with school officials to identify at -risk students and recommend
appropriate treatment and interventions;
Develop a billing system to ensure sustainability of Licensed Mental Health
Professionals;
• Integrate SS/HS project activities with additional agency partnerships, including other
mental health and social service providers in Pueblo County and the State;
Work closely with the PCS, Office of Student Support Services and school officials to
transition students who are in treatments or who have completed treatment back into the
school environment;

• Work closely with the SS /HS Project Coordinator in the planning and delivery of
appropriate professional development for project staff and teams.
• Work with PCS and Parkview Medical Center/ Pueblo Community Health Center to build
collaboration and integration between the physical health services and mental health
services offered through PCS.
• Hire and supervise the Mental Health Supervisor and other mental health professionals
required in this grant per contract agreement with PCS.
• Assure that contract staff participate fully in the SS /HS team at Pueblo City Schools
including meetings, retreats and other activities essential to the success of this grant.
• Provide referral resources for students who need more extensive psychiatric evaluation
and treatment.
• Track student patient encounter data including numbers of unique patients, number of
student encounters, referral data, diagnosis (aggregated data) and other data appropriate
for tracking the impact of this program on students but within the guidelines of HIPAA.
• Provide services to all students regardless of their abilities to pay within the Pueblo City
Schools and provide services to students based on Spanish Peak's established sliding fee
scale for all students who are referred to the organization for additional evaluation or
treatment.
Pueblo, acting by and through its Police Department
Participate fully as a member of the SS /HS Core Management Team;
■ Subject to Contract with PCS, provide school resource officers ( "SRO ") at locations
designated in the contract
Allow appropriate law enforcement staff, including SRO's, to attend SS /HS team
meetings and training activities as needed and appropriate
■ SRO's participate as part of the school -based bully prevention teams
Assist PCS in assessing the current crisis management and response plan for each school;
• Provide support to the Student Crime Stoppers established in schools across the District.
Share information with school officials and mental health care workers to identify at -risk
students and participate in appropriate interventions;
Communicate with school administration and PCS Office of Student Support Services
regarding PCS students who are at -risk and involved in the court system, having direct
impact on school success;
• Work closely with PCS, Tenth Judicial District Combined Courts, and the Probation
Department by providing SRO support to meet with and monitor students who are
transitioning back into the school environment from correctional facilities.
• Participate in the research of Safe -2 -Tell Hotline program to insure that the Student
Crime Stoppers and Safe -2 -Tell are complementary and to insure that anonymity is
clearly addressed between the two programs before Safe -2 -Tell is implemented;
• Work closely with PCS and the Tenth Judicial Combined Courts in the support of PCS
Truancy Policy.
• Educate and inform Core Management Team regarding trends and activities that are
occurring within the community which may negatively impact students or schools in the
community

• Work closely with the SS /HS Project Coordinator in the planning and delivery of
appropriate professional development for project staff and teams as needed.
Tenth Judicial District Combined Courts
■ Participate fully as a member of the SS/HS Core Management Team;
Share information with school officials and mental health care workers to identify at -risk
students and recommend appropriate treatment and interventions;
■ Communicate with school administration and Department of Student Intervention
Services regarding Pueblo City Schools students who are at -risk and involved in the court
system, having direct impact on school success;
■ Work closely with Pueblo City Schools and the Probation Department in transitioning
students who have been in correctional facilities back into the school environment; and
• Work closely with Pueblo City Schools and the in the enforcement of Pueblo City
Schools Truancy Policy.
Office of the District Attorney, Tenth Judicial District
• Participate fully as a member of the SS /HS Core Management Team;
Share information with school officials and mental health care workers to identify at-
promise students and recommend appropriate treatment and interventions;
• Communicate with school administration and Department of Student Intervention
Services regarding PCS students who are at -risk and involved in the court'system, having
direct impact on school success;
• Work closely with PCS, Tenth Judicial Combined Courts, and the Probation Department
in transitioning students who have been in correctional facilities back into the school
environment.
Parkview Medical Center
• Participate fully as a member of the SS /HS Core Management Team;
■ Provide managerial oversight for all School -Based Wellness Center sites either directly
or through a subcontract with Pueblo Community Health Center;
Collaborate with PCS to incorporate mental health services as outlined in the SS/HS
initiative;
■ Continue to provide Family Nurse Practitioners to provide the services necessary to meet
the acute and chronic health care and prevention needs of students;
• Continue to identify students with mental health needs and make referrals to the Student
Family Support Teams and others agencies as needed;
■ Continue to provide leadership in the development of partnerships for School -Based
Wellness Center sustainability;
Continue a relationship with Southern Colorado Family Medicine Residency Program to
have physicians available one day per week at two high school wellness center sites;
• Establish formal substance abuse referral and treatment protocols.
• Work collaboratively with Spanish Peaks Mental Health or other mental health providers
for Pueblo City Schools to develop an integrated healthcare model that includes both
physical and mental health services;

• Work closely with the PCS, Office of Student Support Services and school officials to
transition students who are in treatment or who have completed treatment back into the
school environment;
• Continue support of the PCS wellness centers per a separate agreement between the two
organizations.
Pueblo City/County Health Department
Participate fully as a member of the SS /HS Core Management Team;
■ Provide training on best practices and research to PCS staff regarding teen pregnancy
issues, sexually transmitted diseases, and other health related topics;
Provide training to PCS healthcare providers and staff regarding effective messages to
promote healthy living, tobacco cessation, obesity prevention, physical activity and
healthy sexual behavior.
■ Continue to track infectious disease and notify schools in timely fashion of potential risk
of further transmission;
■ Assist PCS in training in the area of emergency preparedness and include the school
district in regional exercises. PCCHD will also assist with assessing the current crisis
management and response plan for each school;
Provide tobacco education such as the "Through with Chew" program to 6th graders in
February of each year throughout PCS by delivering the program directly to the students
and by partnering with high school clubs, organizations, and health classes to develop a
peer to peer training program.
Implement the "Own Your "C"(choices)" Campaign in Pueblo City Schools targeting 6-
8` graders to emphasize tobacco reduction and the prevention of tobacco use.
• Continue to support the existing Not on Tobacco (NOT) program in Pueblo City Schools
to promote voluntary cessation of tobacco use.
Crossroads Turning Points
■ Participate fully as a member of the SS /HS Core Management Team;
Continue to provide management and support of the after school, alternate to suspension,
underage drinking classes and related activities utilizing the Toward No Drug Abuse
curriculum;
• Actively participate in the SS /HS evaluation process;
■ Provide necessary staff for program expansion;
■ Provide certified trainers for the implementation of Project Northland in PCS Middle
Schools;
Assign appropriate staff to participate in the Project Toward No Drug Abuse (PTNDA)
training
Work collaboratively with Spanish Peaks Mental Health, Parkview Medical Center and
Pueblo City Schools to identify appropriate treatment protocols and criteria by which
students will be referred for formal substance abuse counseling.

X11. Programmatic Reporting
The Department of Education on behalf of the Federal Safe Schools/ Healthy Students
partners requires the submission of performance reports every six months to demonstrate
substantial progress on the grant. Annual reports will include reports on all grant activities,
evaluation data and expenditures. The semi - annual reports will include update on the
progress as measured by the GPRA measures and financial expenditure information. All
partner organizations are asked to participate in the development of the reports by providing
information and data as appropriate to the Project Director in a timely manner so that it may
be included in the reports.

XIII. Roles and Responsibilities of each Partner
Though the Core Management Team will assume responsibility for management and oversight of
the Safe and Healthy Schools Initiative, additional partners will be requested to serve in an
advisory capacity to this Initiative and to the CMT. The roles and responsibilities of these
partners will be defined by the Core Management Team but in general, all partners will
1. Promote a coordinated effort among agencies and staff to achieve maximum school
safety with the goal of creating safe and drug -free schools and promoting healthy family
and childhood development; and
2. Address the collective "big picture" of the entire Initiative and do not limit
considerations /concerns to their own agency;
3. Agree to abide by all the confidentiality provisions required by state and federal law,
including HIPAA regulations;
4. Share information within the boundaries of confidentiality and in compliance with the
Family Education Rights and Privacy Act of 1974, 20 U.S.C. 1232g ( "FERPA ") that can
lend to better care for the student(s) and further success of the initiative in the
community;
5. Promote culturally competent delivery of project services;
6. Participate and cooperate in all related evaluation activities including sharing of
appropriate organizational data quarterly with the project director and evaluator and
participation in the required national evaluation required by the federal government, in
accordance with the policies of each partner agency;
7. Participate in strategic planning and sustainability planning as deemed appropriate by the
CMT;
XIV. Other Community Involvement
Whenever feasible and appropriate, the CMT, Project Director and Safe and Healthy Schools
Initiative will foster collaboration across agencies and will work to be inclusive of school
administrators, teachers, students, parents, other community members and community
organizations.
XV. Terms and Amendments of this MOU
This MOU shall be effective July 1, 2008 and shall continue through .Tune 30, 2012. The partner
agencies do not and do not intend by this MOU to undertake any direct or indirect financial
obligations in the performance of this MOU. Any party may terminate this MOU with or
without cause upon providing 30 days prior written notice to the other parties of this MOU.
The MOU may be amended from time to time as necessary to reflect changes in the roles and
responsibilities of the Partner Agencies. Each party to the MOU must execute a written
amendment in order for such amendment to be effective. Accordingly, Pueblo City Schools will
notify the CMT designee for each party to the MOU by e -mail in the event of a proposed
amendment or amendments to this MOU.
The terms of the MOU are intended to set forth the intended actions of the parties in the future
and are not to be construed to create contractual obligations or legally enforceable rights between
