HomeMy WebLinkAbout11451RESOLUTION NO. 11451 A RESOLUTION APPROVING AN ADDENDUM AGREEMENT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE ROCKY MOUNTAIN RAIL AUTHORITY, A BODY CORPORATE AND POLITICAL SUBDIVISION OF THE STATE OF COLORADO, RELATED TO THE PLANNING, SUPPORT AND FACILITATION OF TRANSPORTATION SYSTEMS, PROGRAMS, SERVICES, IMPROVEMENTS, AND THE ESTABLISHMENT OF HIGH- SPEED RAIL WITHIN THE STATE OF COLORADO AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME WHEREAS, the City Council finds it to be in the best interest of the public and its health, safety, and welfare to provide a transportation alternative to existing modes of transportation in the form of high -speed rail for the Southern Colorado region, and WHEREAS, the City Council and the other political subdivisions of the State of Colorado desire to bring focus to the development of high -speed rail lines in the transportation corridors of Colorado and other viable transportation services and programs, and WHEREAS, the City Council would like to establish cooperation with other governmental entities in the State of Colorado in developing high -speed rail and various transportation facilities, programs, services, and improvements to establish a high- speed rail in the State of Colorado, now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: .qFrTIC)N 1 The City Council herby finds it in the best of interest for the City of Pueblo to be a member of the Rocky Mountain Rail Authority and to actively participate in its function to study and determine the feasibility of high -speed rail transportation projects to the congested corridors of the State of Colorado. SECTION 2. An Addenda Agreement dated November 10, 2008, a copy of which is attached hereto and made a part hereof, after having been approved as to form by the City Attorney, by and between Pueblo, a Municipal Corporation, and the Rocky Mountain Rail Authority, a body corporate and political subdivision of the State of Colorado is hereby approved. SECTION 3. The President of the City Council is hereby authorized to execute the said Agreement on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. BACKGROUND The City Council approved Resolution number 10965 on March 26, 2007 authorizing the allocation of $12,500 to fund the Rocky Mountain Rail Authority (RMRA) feasibility study for commuter rail service along the front range of Colorado. Since that time, other government bodies (Clear Creek County, Town of Monument, Castle Rock, and the Roaring Fork Transportation Authority) have signed contracts joining the Rocky Mountain Rail Authority. It has been requested by the RMRA that the City of Pueblo join their organization to establish a structure and opportunity in the future to define, promote, and implement mass transportation services and solutions to Colorado's growing transportation infrastructure needs. Only political subdivisions of the State of Colorado and agencies of the State may become members of the Authority. Moreover, individual member jurisdictions are not liable for the financial obligations of the Authority and any financial contributions to the Authority by the City are subject to the any of the City's applicable TABOR spending restrictions. RECOMMENDATION Approval of the Resolution. FINANCIAL IMPACT Funding has been appropriated to the Rocky Mountain Rail Authority via Resolution number 10965 passed on March 26, 2007 by the City Council. This amount was $12,500. ADDENDUM # TO THE ESTABLISHING CONTRACT FOR THE ROCKY MOUNTAIN RAIL AUTHORITY AS AMENDED BY THE FIRST AMENDMENT TO THE ESTABLISHING CONTRACT FOR THE ROCKY MOUNTAIN RAIL AUTHORITY Pursuant to Section 1.05 of the Establishing Contract for the Rocky Mountain Rail Authority, entered into by Clear Creek County and the City of Monument, effective November 20, 2006, as amended by the First Amendment thereto (collectively referred to as the "Agreement "), the City of Pueblo, CO hereby agrees to the terms of the Agreement and approves this addendum in order to become a member of the Rocky Mountain Rail Authority. The City of Pueblo's representative on the Rocky Mountain Rail Authority Board of Directors shall be Bill Moore, MPO Administrator the alternate representative shall be Penner Whittle£, City Traffic Engineer The City of Pueblo's financial contribution to the Rocky Mountain Rail Authority shall not exceed $ 6,250 for 2007, $6,250 for 20W and $3,125 for 2009 Upon receipt and acceptance by the Rocky Mountain Rail Authority of this addendum, the City of Pueblo will be a party to the Agreement.
