HomeMy WebLinkAbout11447RESOLUTION NO. 11447 A RESOLUTION APPROVING AN APPLICATION FOR INTERIM REMEDIATION AND CONSTRUCTION WORK UPON THE PHASE III UNIT OF PUEBLO SOUTHSIDE LANDFILL WHEREAS, on June 22, 1992, Council adopted Resolution No. 6951 which ratified, approved and authorized a separate Certificate of Designation for municipal solid waste landfill units identified as Phase II and Phase III of the Pueblo Southside Landfill; and WHEREAS, said Certificate of Designation for the Phase III Unit was effective and the facility began operation prior to adoption of Ordinance 5996 of the City of Pueblo, passed and approved on July 24, 1995; and WHEREAS, on July 14, 1997, Council adopted Ordinance No. 6208 which approved with conditions a major modification to said Certificate of Designation for the Phase III Unit, Pueblo Southside Landfill, which modification had been requested by the operator, Zupan Enterprises, Inc.; and WHEREAS, on April 26, 2004, Council adopted Ordinance No. 7130 which approved with conditions a major modification to said Certificate of Designation for the addition of new liquid waste and sludge impoundments to the Phase III Unit, Pueblo Southside Landfill, which modification had been requested by the operator Zupan Enterprises, Inc.; and WHEREAS, Zupan Enterprises, Inc., by its contractor Waste Connections of Colorado, Inc. ( "WCI "), has now submitted an application for Interim Remediation and Construction Work (the "Application "), a true copy of which is attached hereto, in order to correct certain deficiencies observed in Phase III and to allow its subsequent reopening and to obtain compliance with regulatory requirements; and WHEREAS, the Application does not seek modification to the Certificate of Designation subject to the provisions of Ordinance 5996, as codified in Chapter 12 of Title IV of the Pueblo Municipal Code and of Part 1 of Article 20 of Title 30, Colorado Revised Statutes, but rather, only seeks approval of temporary corrective modifications; and WHEREAS, the Application has been reviewed by the Colorado Department of Public Health and Environment ( "CDPHE ") and CDPHE has indicated its concurrence that the remediation and construction described in the Application should be performed; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 The Application for approval of Interim Remediation and Construction Work upon the Phase III Unit, as set forth in the Application, is hereby approved, and is found not to constitute a major modification or minor modification to the Certificate of Designation for the Phase III Unit facility. SECTION 2 This Resolution shall become effective immediately upon final passage and approval. RECOMMENDATION Approval is recommended in order that the solid waste disposal facility reopen at the earliest possible time. BACKGROUND On July 28, City Council approved a transaction which essentially allowed Waste Connections, Inc. ( "WCI ") to evaluate Phase II and III of the Pueblo Southside Landfill, and authorized WCI to obtain approval to acquire Phase II and III from Zupan Enterprises and subsequently reopen the Landfill upon specified terms. As part of the evaluation process, certain remedial /corrective work has been identified and may be performed prior to (a) the closing of the above - described transaction, and (b) City action on modification of the Certificate of Designation for the Phase II and Phase III Units. By allowing the remedial work to proceed on this basis, identified problems with the facility will be corrected and the re- opening of the facility may logically proceed without unnecessary delay. Approval of this Resolution is consistent with protection of public health and safety. FINANCIAL IMPACT None. Galli: The purpose of this application, submitted on behalf of Zupan Enterprises, Inc., is to request approval for an interim remediation and construction project that is planned at the Southside Landfill. To facilitate the City's review of this request, a site plan is attached The proposed remediation and construction work that will be performed for the area is known as "Phase III" at the landfill_ This request includes Module A, as shown on Drawing 1. Module B will be constructed at a later date. The proposed work is summarized below.. • Perimeter Berm. A perimeter berm will be constructed in the area southeast of Phase III. The perimeter berm will be constructed of compacted soil and tested to verify that the project compaction specifications are met. • Extension of Existing Lined Area As shown on Drawing 1, the existing liner will be extended between the existing limits of waste and the top of'the perimeter berm. The waste disposal area, or "landfill footprint," will be extended by this construction project to allow the slopes of Phase III to be re- shaped to meet applicable regulatory requirements., the remediation and construction work will be completed by Waste Connections of Colorado, Inc. and their subcontractors on behalf' of Zupan Enterprises, Inc. The remediation and construction work will begin upon receiving City approval of this project.
