A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A WARRANTY DEED AND THE
EASEMENT AND RIGHT OF WAY FROM PUEBLO SUBURBAN DEVELOPMENT, LLC, A
COLORADO LIMITED LIABILITY COMPANY
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:

The attached Warranty Deed and the Easement and Right of Way for public utilities
between Pueblo, a Municipal Corporation, and Pueblo Suburban Development, LLC, a Colorado
Limited Liability Company having been approved as to form by the City Attorney, are hereby
approved.
SECTION 2.
The City Clerk is directed to cause said Warranty Deed and Easement and Right of Way to
be recorded in the office of the Pueblo County clerk and Recorder forthwith.

ISSUE
Should the City Council authorize the acceptance of a Warranty Deed and the Easement
and Right of Way from Pueblo Suburban Development, LLC, a Colorado Limited Liability
Company.
RECOMMENDATION
Approval of this Resolution
BACKGROUND
The purpose of the deed and the easement/right of way is to facilitate the development of
the property located north of existing Lime Road, south of the present improved Greenhorn
Drive, east of Interstate 25, and west of the Denver and Rio Grande Western railroad.
FINANCIAL IMPACT
There is no financial impact to the City of Pueblo due to this action.

WITNESS, that the grantor, for and in consideration of the sum of One Dollar and other
good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, has
granted, bargained, sold and conveyed, and by these presents does grant, bargain, sell, convey and
confirm unto the grantee, its successors and assigns forever, all the real property, together with
improvements, if any, situate, lying and being in the County of Pueblo, State of Colorado, described as
follows:

law or equity, of, in and to the above bargained premises, with the hereditaments and appurtenances;
TO HAVE AND TO HOLD the said premises above bargained and described, with the
appurtenances, unto the grantee, its successors and assigns forever. The grantor, for himself, his
successors and personal representatives, does covenant, grant, bargain and agree to and with the
grantee, its successors and assigns, that at the time of the ensealing and delivery of these presents, it is
well seized of the premises above conveyed, has good, sure, perfect, absolute and indefeasible estate of
inheritance, in law, in fee simple, and has good right, full power and authority to grant, bargain, sell and
convey the same in manner and form as aforesaid, and that the same are free and dear from all former
and other grants, bargains, sales, liens, taxes, assessments, encumbrances and restrictions of whatever
kind or nature soever, except easements, rights -of -way, restrictions, reservations, and covenants of
record.
The grantor shall and will WARRANT AND FOREVER DEFEND the above bargained premises in

A parcel of land located in a portion of the E %Z of Section 26 and the NE '/4 of Section 35,
Township 21 South, Range 65 West of the a P.M. in the County of Pueblo and State of
Colorado being 80 feet in width, 40 feet on each side of the following described centerline:
Considering a portion of the South line of the NE '/4 of Section 35, Township 21, South, Range
65 West of the 6 P.M. to bear N. 89 " W., and all bearings contained herein being relative
thereto.
Commencing at the most Southerly comer of Minnequa Industrial Park, Second Filing according

EASEMENT AND RIGHT OF WAY

WITNESSETH:
THAT IN CONSIDERATION of the sum of One Dollar ($1.00) and other good and valuable
consideration paid by the Grantee, receipt of which is hereby acknowledged, Grantor hereby grants to
Grantee, its successors and assigns, an easement and right of way for the purpose of public utilities_ in,
through, over, under and across Grantor's property situated in Pueblo County, Colorado, commonly
known as and described as follows: (the "Property")
See attached Exhibit "A"
TOGETHER WITH the right to enter upon the Property for the purposes of construction,
replacement, maintenance, control, and repair, and the right to use so much of the adjoining property of
Grantor for said purposes. The Grantor reserves the right to use and occupy the Property for any purpose
not inconsistent with the right and privilege above granted and which will not interfere with or endanger
any of Grantee's equipment or facilities therein or use thereof. Such reservation by the Grantor shall in
no event include the right to locate or erect or cause to be located or erected on the Property any building
or any other structure or manufactured or mobile home or trailer unit.
Grantor warrants to Grantee that Grantor (a) has good and sufficient right and title in and to the
Property and full power to grant this easement and right -of -way, and (b) will defend Grantee's quiet and
peaceful possession of the Property and easement and right -of -way against all persons who may lawfully
claim title to the property.
"Grantee" shall include the plural and the feminine. This Easement And Right Of Way shall be
binding upon, and shall inure to the benefit of the heirs, personal representatives, successors, and assigns
of the Grantor and Grantee.

LAND DESCRIPTION
An easement for Public Utility purposes located in a portion of the SE '/4 of Section 26 and the
NE' /4 of Section 35, Township 21 South, Range 65 West of the o P.M. in the County of Pueblo
and State of Colorado being more particularly described as follows:
Considering a portion of the South line of the NE '/a of Section 35, Township 21, South, Range
65 West of the 6 P.M. to bear N. 89'42'11 " W., and all bearings contained herein being relative
thereto.
Commencing at the E '/4 comer of Section 35; thence N. 32 °14'31" W., a distance of 4079.01
feet to the Point of Beginning, said point also being on the Easterly right -of -way line of Colorado
Interstate No. 25 as presently located; thence Southeasterly along an arc of a curve to the left
whose radius is 540.00 feet and whose center bears S. 86'48'12" E., a distance of 296.25 feet;
