A RESOLUTION AUTHORIZING THE CITY OF PUEBLO TO APPLY FOR A 2008 EDWARD
BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) AND APPROVING A
MEMORANDUM OF UNDERSTANDING CONCERNING RECEIPT AND DISBURSEMENT OF
FUNDS FROM SAID GRANT AND AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL TO
EXECUTE SAME
WHEREAS, the City of Pueblo Police Department is requesting that the City of Pueblo
submit an application to the United States Department of Justice (DOJ) for the 2008 Edward Byrne
Memorial Justice Assistance Grant (JAG); and
WHEREAS, the funds from this grant will be utilized by the Police Department, Sheriff's
Department, and the District Attorney's Office to benefit the health, welfare and safety of the
citizens of the City; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The 2008 JAG Local Solicitation Application #2008- F4080 -CO -DJ (Grant Application), a copy
of which is attached hereto is hereby approved and authorized for submittal to the United States
Department of Justice.
SECTION 2.
The Memorandum of Understanding, dated as of June 4, 2008, by and between the City of
Pueblo, a Municipal Corporation and Pueblo County, Colorado concerning the receipt and
disbursement of the 2008 JAG funds is hereby approved.
SECTION 3_
The President of the City Council is authorized to execute the Grant Application and
Memorandum of Understanding in the name of the City.

ISSUE
The United States Department of Justice (DOJ) has informed the Police
Department that funds are available under the Edward Byrne Memorial Justice
Assistance Grant (JAG). These funds are to be divided between the City and
County to their mutual satisfaction as per the attached Memorandum of
Understanding.
RECOMMENDATION
The department recommends approval of this resolution.
BACKGROUND
The Edward Byrne Memorial Justice Assistance Grant (JAG) Program provides
funds to units of local government for the purpose of improving law enforcement
technology and upgrading necessary equipment. The program is designed to
help local communities address problems specific to their area.
FINANCIAL IMPACT
None. There is no local match required.

Edward Byrne Memorial Justice Assistance Grant (JAG) for FY 2008
Program Narrative
"Crime rates for the first half of 2007 dropped in all of Colorado's major cities except Pueblo,
preliminary FBI statistics released Monday show (emphasis added). The state's trend mirrored
that of the rest of the nation, which saw a 1.8 percent drop in violent crime and a 2.6 percent
decline in property crime. The only two cities to report an increase in violent crime were Pueblo
and Arvada. Violent crime in Pueblo increased 23.2 percent. Pueblo was also one of two
jurisdictions that saw increases in property crime. Pueblo's property crime grew 6.3 percent
from 3,053 to 3,246. Pueblo Police Chief Jim Billings linked the increases in property crime to
Methamphetamine. `We've been aware there's a meth problem but we haven't had the resources
to address it,' Billings said. "(Rocky Mountain News; Crime rates down across state in first half

The City of Pueblo has a significant crime problem, as indicated by the statistics cited in the
opening paragraph. Aside from the rising violent and property crime rates, the Pueblo Police
Department saw a 9.1% increase in 911 calls — up from 70,994 in 2006, to 77,509 in 2007. Calls
for service were also up in 2007. There was a 3.1 % increase, from 128,853 in 2006, to 132,849
in 2007.
In order to more effectively deal with these increases in calls for service, and the steadily
rising crime rates, the City of Pueblo, through its Police Department, would like to utilize the
latest technologies that are available. There are numerous technologies obtainable that would
contribute significantly to making our limited number of officers more efficient and productive.
Some of the technologies, such as Thermal Imagers, are essential, officer - safety mandated tools.
Thermal imagers detect body heat, allowing officers to "see" through darkness and camouflage,
permitting them to locate suspects and preventing escapes and ambushes. Another example of
available technologies include License Plate Readers, which scan thousands of license plates in a
shift and instantly notify the officer of stolen vehicles, stolen plates, wanted parties, known gang
members, etc. Additionally, laptop computers have become probably the single most important
tool at an officer's disposal, yet the Pueblo Police Department struggles to replace its aging
laptop inventory. Laptop computers are used by officers for everything from receiving CAD
calls for service, to writing and submitting their reports, and running clearances. Most of these
technologies are complimentary to each other, in that License Plate Readers utilize the existing
officer's laptop to display the "hits" it gets. "Toughbook" laptops are by far the ideal laptop to
use, but their cost, at $5,000 each, is cost prohibitive. At minimum, "ruggedized" laptops are
required, yet they still cost approximately $2,500 each. These examples demonstrate the wide
variety of technologies that are available, if only funding can be found.
The City of Pueblo, through its Police Department, has maintained a long- standing
mutual coordination with the Pueblo County Sheriff s Office and the Pueblo County District
Attorney's Office — the other agencies within the disparate jurisdiction - in regards to law
enforcement programs and services. This mutual assistance and coordination has been
exemplified by our joint involvement in DARE Programs, Emergency Management Systems,
and public service events. The Pueblo Police Department and the Pueblo County Sheriff's
Office have also recently partnered with each other on a Colorado Department of Public Safety,
Division of Criminal Justice, Anti -Gang Initiative and Gun Violence Reduction grant. Both
agencies will work together as a team to combat gang activities and gun violations, which tend to
go hand -in -hand. Further illustrations of the Pueblo Police Department's commitment to
collaborations with other local, State and Federal agencies include the Pueblo Police
Department's dedication of four of its officers to assignment with the Drug Enforcement
Agency's Southern Colorado Drug Task Force. That partnership has just been extended for an
additional two years. Additionally, the Pueblo Police Department has another officer assigned to
the Federal Bureau of Investigation's National Joint Terrorism Task Force, another worthy
partnership, and is actively working with the Bureau of Alcohol, Tobacco and Firearms. We
anticipate continued coordination and cooperation among these agencies.
As a certified disparate jurisdiction submitting a joint application, the City of Pueblo will
receive $25,064.00, or 76% of the total award amount of $32,979.00. The City will use these
funds to purchase equipment for law enforcement projects and programs. The County will
receive $7,915.00 of which the Pueblo County Sheriff s Department will receive $6,332.00 to
purchase equipment for law enforcement. The Pueblo County District Attorney will receive
$1,583.00 of the County's allocation to purchase law enforcement equipment.

Budget Narrative
The City of Pueblo and Pueblo County are a certified disparate jurisdiction. Per the
Memorandum of Understanding that has been established between the City of Pueblo, Pueblo
County Sheriff's Department and Pueblo County District Attorney's Office, the City of Pueblo
will receive $25,064.00, or 76% of the total award amount of $32,979.00. The City will use
these funds to purchase equipment for law enforcement projects and programs. The County will
receive $7,915.00 of which the Pueblo County Sheriffs Department will receive $6,332.00 to
purchase equipment for law enforcement. The Pueblo County District Attorney will receive
$1,583.00 of the County's allocation to purchase law enforcement equipment.
Since the length of the award is for a total of 4 years, it is anticipated that the City of
Pueblo would spend approximately 25% of the total award, or $6,266.00 each year for the next 4
years. The expended funds would be used to purchase and upgrade technology and equipment as
required, fulfilling our law enforcement and community policing mission.

Review Narrative
The City of Pueblo is governed by a seven - member City Council and the City is managed
by the City Manager, David J. Galli, who is appointed by the City Council. The President of
City Council, Barbara Vidmar, is the authorized grantee official. The grant application was
completed online on or about June 4, 2008. The grant application was made available for review
to the members of City Council and the City Manager on or about June 23, 2008. The grant
application was also made available for review to members of the Pueblo County Commissioners
on or about June 24, 2008. It is anticipated that the grant application will be submitted on or
about July 3, 2008. Although the 30 day review period requirement cannot be satisfied before
the application is submitted, the grant application will have made available for review to the
governing body of the City of Pueblo, and the County of Pueblo more than 30 days before the
award is accepted.
Additionally, on or about the first week of July, 2008, a public meeting concerning this
grant application will be advertised in the following local newspapers: The Pueblo Chieftain, The
Pueblo West View, and Horizons. Citizens and neighborhood or community organizations will
be invited to participate in the public meeting and offer comments in regards to the stated
purposes of the grant funds. On or about the first week of July, 2008, this public meeting will be
conducted at the Pueblo Police Department's facilities.
MEMORANDUM OF UNDERSTANDING
CONCERNING RECEIPT AND DISBURSEMENT OF
EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG)
FUNDS FOR FY 2008
THIS MEMORANDUM OF UNDERSTANDING is made and entered into
this 4th day of June, 2008, by and between the City of Pueblo, a Municipal
Corporation (hereafter referred to as the "City ") and Pueblo County, Colorado
(hereafter referred to as the "County ").
WITNESSETH:
WHEREAS, the parties recognize that for FY 2008 Edward Byrne Memorial
Justice Assistance Grant (JAG) funding, administered by the U.S. Office of Justice
Programs, Pueblo County has been certified as a disparate jurisdiction by the
Colorado State Attorney General's Office; and
WHEREAS, Federal Edward Byrne Memorial Justice Assistance Grant
funding requires that a certified disparate county and the city or cities within the
county are to divide available funds to their mutual satisfaction, and that if the
parties are unable to reach a mutual agreement, no jurisdiction is eligible to receive
funds; and
WHEREAS, the parties reached an agreement over the receipt of
$32,979.00 in JAG funds and the disbursement of those funds and wish to set
such agreement as follows.
NOW, THEREFORE, in consideration of the, mutual covenants contained
herein and in accordance with Federal law, the parties agree as follows:
I . The $32,979:00 JAG Grant Funds will be allocated as follows: The
City will receive $25;064.00 to purchase equipment for law enforcement. The
County will receive $7,915.00 of which the Pueblo County Sheriff's Department
will receive $6,332.00 to purchase equipment for law enforcement. The Pueblo
County District Attorney will receive $1,583.00 of the County's allocation to
purchase equipment for law enforcement: The City will serve as the applicant/fiscal
agent. 1 .

2. The City, County, Pueblo County Sheriff's Department and Pueblo
County District Attorney shall meet and comply with the .general and special
conditions set forth in the FY 2008 JAG Grant Funds Award.
