A RESOLUTION AUTHORIZING STAFF TO SOLICIT PROPOSALS FROM ARTISTS TO
PROVIDE PUBLIC ART AT THE NEW POLICE BUILDING, BID THE ANNEX PORTION OF THE
PROJECT SEPARATELY AND TO CLARIFY DIRECTION ON PERFORMING AN INDEPENDENT
AUDIT OF THE MECHANICAL SYSTEMS IN THE COMPLETED BUILDINGS
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
City Staff is hereby authorized to solicit proposals from artists to provide public artwork at
the new Police Building, and allocate up to $250,000 for said artwork.
SECTION 2_
City Staff is hereby authorized to bid the Annex portion of the Police Building Project
separately from the main building.
SECTION 3_
City Staff is hereby authorized to solicit proposals to perform an independent audit
(Commissioning) of the mechanical systems in both of the completed buildings relating to the new
Police Building in the Spring 2010.

ISSUE
Should City Council authorize staff to solicit proposals from artists to provide artwork at
the new Police Building, and if so, what amount should be allocated for the artwork?
Should City bid the Annex portion of the project separately? Council needs to give
direction on the process to be used to perform an independent audit (Commissioning) of
the mechanical systems in both buildings once completed?
RECOMMENDATION
Approval of the Resolution.
BACKGROUND
On May 12, 2008, City Council received an update from the architects, Durrant and
HGF Architects, and staff on the progress of the design of the new Police Building and
Complex. City staff asked for input from Council regarding three items relating to the
project.
1. To authorize Staff to solicit proposals from local artist to provide art on, or around,
the new Police Building in an amount up to $250,000?
2. Whether or not the City should bid the Annex portion of the new police building
project separately from the main Police Building. The construction of the Annex will
take approximately 10 months. If the Annex were to be included with the overall bid
package for both the Annex and the Police building, then construction on the Annex
could take the entire 18 to 20 months. By bidding the Annex separately, it will allow
more contractors to be involved in the project, and potentially provide more
competitive pricing. It will also allow the police to move their vehicles and evidence
into the Annex sooner.
3. Clarify direction as it relates to the commissioning of the mechanical systems in the
new police buildings once completed. The City can handle commissioning of the
mechanical system (HVAC) in two ways. First, staff can solicit proposals from an
independent engineer, who would work for the City as a third party consultant. This
consultant would perform an inspection and complete a written audit of the installed
HVAC system. The consultant would determine if the system is installed and
working per the plans and specifications, determine if the systems settings are
correct, list any differences, document these findings and certify that the systems are
functioning properly. Since the commissioning would not need to be done until the
project is complete, the City would not need to hire this consultant until the project is
near completion (Spring of 2010). This option could cost anywhere from $45,000 to
$75,000 in additional funds. Second, the City could contract with a third party
consultant as soon as possible and have them involved with reviewing the design,
construction documentation and specifications. During construction, they would
perform independent inspections and complete final testing. Then after the system
is installed, they would provide an audit of the system, necessary training review and
final reporting. This option would delay the bidding of the project due to the time
need for the third party to review and comment on the design. This option could cost
anywhere from $58,000 to $80,000 in additional funds.
As part of the contract award to build the new police building, the selected contractor will
be required to install the system in accordance with the plans, specifications and
manufacturer requirements. In addition, the system will have a warranty. The contractor
will be required to test and balance the system, provide training for staff and provide
product manuals. Also, as part of the architects Construction Management
responsibilities, they are required to have their sub - consultants (Mechanical Engineers)
perform inspections to ensure the City is getting what is required. This is already
included as part of their fees.
FINANCIAL IMPACT
Adding public art and an independent commissioning to the project will add costs to the
project. Bidding the Annex portion of the project may or may not add costs.
