HomeMy WebLinkAbout11288RESOLUTION NO. 11288 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF PUEBLO AND SHORT ELLIOT HENDRICKSON, INC., FOR PROFESSIONAL SERVICES ASSOCIATED WITH THE DILLON DRIVE /1 -25 OVERPASS "AIR- RIGHTS PERMIT" STUDY — PROJECT NO. 07 -054 (DT0802) BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Agreement between the City of Pueblo and Short Elliot Hendrickson, Inc., for professional services associated with the Dillon Drive / 1 -25 overpass "Air- Rights Permit" Study — Project No. 07 -054 (DT0802), a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. Funds for said professional services shall be paid from Account Code CP0802. SECTION 3_ The President of the City Council is hereby authorized to execute the said Agreement on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. TITLE A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF PUEBLO AND SHORT ELLIOTT HENDRICKSON, INC., FOR PROFESSIONAL SERVICES ASSOCIATED WITH THE DILLON DRIVE /1 -25 OVERPASS "AIR - RIGHTS PERMIT" STUDY — PROJECT NO. 07 -054 (DT0802) ISSUE Should the City Council enter into an agreement with Short Elliott Hendrickson, Inc., for the purpose of performing professional services associated with the Dillon Drive /1 -25 Overpass "Air- Rights Permit" Study. RECOMMENDATION Approval of this Resolution. BACKGROUND Recent growth on the City of Pueblo's north side adjacent to 1 -25 will necessitate the connection of Dillon Drive across the interstate at approximately Mile Post 103 with the potential for a future connecting interchange. The "Air- Rights Permit' Study is the first step in the process of creating a new flyover and is necessary to obtain the required permit from CDOT. The long -range transportation plan is to provide for a split diamond interchange at Dillon Drive and I -25. FINANCIAL IMPACT The City has received a grant from the Federal Highway Administration for $5.427 million to pay for the study and design of a flyover and to construct that portion of the flyover with the remaining funds. A concurrent Council action approves the acceptance of said grant of up to $800,000 and transfers a previously authorized $200,000 (Ordinance No. 7464 dated August 13, 2007) from the City's Reserve Account Fund into the project account (DT0802). The grant has a 20% local agency (City) match requirement. The City's 20% match for the study will initially be funded from the General Fund Reserves Account, however revenues from the North Pueblo Urban Renewal Project Tax Increment Financing (TIF) will be used to reimburse the general fund, subject to approval by the Urban Renewal Authority. The cost for the study by a consultant will be negotiated as required by Federal and State statutes and is currently estimated at roughly $830,000. If the cost of the study exceeds the amount of funds available from the City's match and that portion of the Federal grant encumbered by the ordinance, then the City will then seek additional monies from the General Fund Reserves as 20% match for additional grant funds.
