HomeMy WebLinkAbout11256RESOLUTION NO. 11256 A RESOLUTION REVOKING THE REVOCABLE PERMIT FOR THE PURPOSE OF INSTALLING LANDSCAPING IN THE PUBLIC RIGHT -OF -WAY GRANTED BY RESOLUTION NO. 8264. WHEREAS, the City Council issued by Resolution No. 8264 a revocable permit for the purpose of installing landscaping in the public right -of -way to Dillon Real Estate Co., Inc.; and WHEREAS, the remainder of the public right -of -way along Red Creek Springs road is necessary to complete a safety project at the intersection of Pueblo Blvd and Red Creek Springs Road /Rutgers Ave; BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 _ The revocable permit granted by Resolution No. 8264 for the purpose of installing landscaping within the public right -of -way along Red Creek Spring Road is hereby revoked. SECTION 2_ This resolution shall become effective immediately upon final passage and approval. TITLE A RESOLUTION REVOKING THE REVOCABLE PERMIT FOR THE PURPOSE OF INSTALLING LANDSCAPING IN THE PUBLIC RIGHT -OF -WAY GRANTED BY RESOLUTION NO. 8264, ISSUE Shall the City Council revoke the revocable permit granted by Resolution No. 8264, a copy attached hereto, allowing Dillon Real Estate Co. Inc. to install landscaping in the public right - of -way. Approval of Resolution BACKGROUND The Colorado Department of Transportation in cooperation with the City Transportation Department has received safety funds to improve the intersection of Pueblo Blvd. and Red Creeks Springs Road /Rutgers Avenue. The proposed improvements will install a right turn deceleration lane on Pueblo Blvd for the southbound to westbound right turn movement, widen Red Creek Springs Road to increase intersection capacity and efficiency and upgrade the existing traffic signal equipment. To accommodate the widening of Red Creeks Springs Road the project will need full use of the existing platted right -of -way, thereby necessitating the revocation of the resolution. City staff has met with the property owner to discuss the project and associated impacts to the existing landscaping. Based on a field visit it appears as the property owner will responsible for replacing several trees and a 3'x 60' strip along Red Creeks Springs Road. The property owner has been cooperative and is fully responsible for all costs associated with the revocation of the permit, including movement, replacement and relocation of the required landscaping.
