A RESOLUTION ACCEPTING CONVEYANCE OF A WARRANTY DEED FROM NEW
BEGINNINGS MINISTRIES, INC., FOR REAL PROPERTY LOCATED AT 631 WEST CORONA
WITHIN PUEBLO, COLORADO
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The warranty deed granted by New Beginnings Ministries, Inc., dated September 17,
2007, a copy of which is attached hereto, after having been approved as to form by the City
Attorney, is hereby approved and accepted.
SECTION 2.
The City Clerk is directed to record said warranty deed in the office of the Pueblo County
Clerk and Recorder.

ISSUE
Should the City Council accept a Warranty Deed from New Beginnings Ministries, Inc.,
for the purpose of providing additional right -of -way to widen the street along Nelson and
Sumner Avenues.
RECOMMENDATION
Approval of this Resolution.
BACKGROUND
The City of Pueblo has prepared plans for a future CDBG project to construct street
improvements to Nelson Avenue and adjacent streets. This Warranty Deed will allow for
the necessary minimum street width of thirty feet along Nelson and Sumner Avenues.

WARRANTY DEED
THIS DEED, Made this 17 ° i day of September 2007, between NEW BEGINNINGS MINISTRIES, INC.,
Of the County of Pueblo and State of Colorado, grantor, and the CITY OF PUEBLO, a Municipal
Corporation, whose legal address is I City Hall Place, Pueblo, Colorado 81003, of the County of Pueblo
and State of Colorado, grantee:
WITNESSETH, That the grantor(s), for and in consideration of the sum of One Dollar and other
good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, has
granted, bargained, sold and conveyed, and by these presents together with improvements, if any, situate,
lying and being in the County of Pueblo and State of Colorado, described as follows:
See Exhibits "A" and "B"
Also known by street and number as: 631 West Corona Avenue
TOGETHER with all and singular the hereditaments and appurtenances thereunto belonging, or in any
wise appertaining, and the reversion and reversions, remainder and remainders, rents, issues, and profits
thereof, and all the estate, right, interest, claim and demand whatsoever of the grantor(s), either in law or
equity, of, in and to the above bargained premises, with the hereditaments and appurtenances.
TO HAVE AND TO HOLD the said premises above bargained and described, with the appurtenances
unto the grantee(s), heirs and assigns forever. And the grantor(s), for himself, his heirs and assigns, that
at the time of the ensealing and delivery of these presents is well seized of the premises above conveyed,
has good, sure, perfect, absolute and indefeasible estate of inheritance, in law, in fee simple, and has good
right, full power and lawful authority to grant, bargain, sell and convey the same in manner and form as
aforesaid, and that the same are free and clear from all former and other grants, bargains, sales, liens,
taxes, assessments, encumbrances and restrictions of whatever kind or nature soever.
The grantor(s) shall and will WARRANT AND FOREVER DEFEND the above- bargained premises in
the quiet and peaceable possession of the grantee(s), his heirs and assigns, against all and every person or
persons lawfully claiming the whole or any part thereof.

Nelson and Sumner Right of Way Widening
A parcel of land being a portion of Lots 1 and 2, Delavan Place Subdivision of Block I,
South Pueblo, according to the recorded plat thereof, filed for record July 30, 1890 in
book 6, pages 25 and 26 and Lot 13, Block I, South Pueblo, according to the recorded
plat thereof, filed for record December 13, 1872 in the records of the Pueblo County
Clerk and Recorder of Pueblo Colorado, being more particularly described as follows:
Beginning at the SE Corner of said Lot 1, Block 7, Delavan Place Subdivision, thence
Northeasterly along the Easterly line of said Lot 1, said line also being the Westerly Right
of Way of Nelson Avenue, a distance of 128.60 feet more or less to the NE corner of said
Lot 1, thence Northwesterly along the Northerly line of said Lot 1, said line also being
the Westerly Right of Way line of Sumner Avenue, a distance of 28.90 feet more or less
to the NE corner of said Lot 2, Delavan Place Subdivision, thence Northwesterly along
the Northerly line of Lot 2, said line also being the Westerly Right of Way line of Sumner
Avenue, a distance of 33.53 feet more or less to the NW corner of said Lot 2 Delavan
Place Subdivision, thence Northeasterly along the Easterly line of said Lot 13, Block I,
South Pueblo, said line also being the Westerly Right of Way of Sumner Ave. a distance
of 132.32 feet more or less to the NE corner of said Lot 13, thence Northwesterly along
the Northerly line of said Lot 13, said line also being the Southerly Right of Way of an
alley West of Sumner Avenue, a distance of 7.99 feet more or less to a point on the south
right of way line of said alley. Thence Southwesterly along new Right of Way and
parallel to the Easterly right of way line of Sumner Avenue, a distance of 111.91 feet
more or less to a point, thence along the arc of a curve to the left having a central angle of
44 °36'52" and a radius of 53.00 feet, a distance of 41.27 feet to a point, thence
continuing along said new Right of Way, a distance of 26.33 feet to a point, thence along
the arc of a curve to the right having a central angle of 46 °30'30" and a radius of 88.16
feet, a distance of 71.56 feet to a point, thence Southwesterly along new Right of Way
and parallel to the Westerly Right of Way of Nelson Avenue, a distance of 65.35 feet
.more or less to the intersection of the Northerly Right of Way of Corona Avenue, thence
Southeasterly along said Northerly Right of Way Corona Avenue, a distance of 1.67 feet
more or less to the point of beginning.
