HomeMy WebLinkAbout11230RESOLUTION NO. 11230 A RESOLUTION FINDING SUBSTANTIAL COMPLIANCE WITH COLORADO REVISED STATUTES SECTION 31 -12 -107 (1) OF THE PETITION FOR THE ANNEXATION OF THE AREA COMMONLY KNOWN AS THE BLUFFS ANNEXATION PHASE 1 AND DESCRIBED AS WEST OF THE INTERSECTION OF PUEBLO BLVD AND WEST 29 ST AND EAST OF PUEBLO MOTORSPORTS PARK WHEREAS, a Petition For Annexation of the area described in Section 1 hereof has been filed with the City Clerk, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 _ The Petition For Annexation of the following described area situated in Pueblo County, Colorado, is hereby found and determined to be in substantial compliance with the provisions of C.R.S. §31 -12 -107 (1): AREA TO BE ANNEXED: The E Y2 NE' /4 NE' /4 of Section 21, Township 20 South, Range 65 West of the 6 th P.M., Except that part described as follows: Beginning at a point on the north line of Section 21, Township 20 South, Range 65 West of the 6 th P.M., from which the northeast corner of said Section 21 bears S. 89 53' 30" East, a distance of 400.0 feet; 1. Thence S. 2 15' 30" E. a distance of 2,629.0 feet to a point on the South line of the NE Y4 of said Section 21; 2. Thence along said South line N. 89 50' 30" East, a distance of 300.00 feet to the E Y4 corner of the said Section 21; 3. Thence along the East line of said Section 21 N. 0 05'W., a distance of 2,625.3 feet to the NE corner of said Section 21; 4. Thence along the North line of said Section 21 N. 89 53' 30" W., a distance of 400.0 feet, more or less, to the point of beginning, County of Pueblo, State of Colorado. Said Parcel contains 8.60 acres more or less. At least one -sixth (1/6) of the boundary of the land described above is existing City Limits Line. PROPOSED NEW CITY LIMITS LINE Beginning at a point on the north line of Section 21, Township 20 South, Range 65 West of the 6 th P.M., from which the northeast corner of said Section 21 bears S89 0 53'30 "E a distance of 400.0 feet, said point being on the westerly right of way line of State Highway 45, also known as Pueblo Boulevard; thence S2 0 15'30 "E, along said westerly right of way line, a distance of 1315.58 feet to a point on the south line of the E Y2 NE Y4 NE Y4 of said Section 21; thence S89 0 58'30 "W, along said south line a distance of 309.89 feet to the southwest corner of said E Y2 NE 1 /4N E Y4; thence N0 0 05'00 "W, along the west line of said E Y2 NE 1 /4N E Y4, a distance of 1314.18 feet to the northwest corner of said E Y2 NE 1 /4N E Y4; thence S89 0 53'30 "E, along said north line of Section 21, a distance of 260.0 feet, to the POINT OF BEGINNING. BASIS OF BEARING: The east line of said Section 21, assumed to bear N 0 005'00 "W SECTION 2_ A public hearing to determine if the area proposed to be annexed meets the applicable requirements of C.R.S. §31 -12 -104 and C.R.S. §31 -12 -105 to establish eligibility for annexation under the Municipal Annexation Act of 1965 shall be held before the City Council in Council Chambers, Second Floor, City Hall, One City Hall Place, Pueblo, Colorado on Monday, April 14, 2008, commencing at 7:00 p.m. or as soon thereafter as City Council business allows. The City Clerk shall publish notice of the public hearing once a week for four successive weeks in the Pueblo Chieftain. The first publication of such notice shall be at least thirty (30) days prior to the date of the hearing. A copy of the published notice, together with a copy of the Petition for Annexation, shall be sent by registered mail by the City Clerk to the Board of County Commissioners and the County Attorney of Pueblo County and to any school district or special district having territory within the area to be annexed at least twenty five days prior to the date of the hearing. PACHECO, DIRECTOR TITLE A RESOLUTION FINDING SUBSTANTIAL COMPLIANCE WITH COLORADO REVISED STATUTES SECTION 31 -12 -107 (1) OF THE PETITION FOR THE ANNEXATION OF THE AREA COMMONLY KNOWN AS THE BLUFFS ANNEXATION PHASE 1 AND DESCRIBED AS WEST OF THE INTERSECTION OF PUEBLO BLVD AND WEST 29 ST AND EAST OF PUEBLO MOTORSPORTS PARK ISSUE Shall the City Council approve and adopt findings and determination concerning the proposed annexation? RECOMMENDATION The City Planning staff has reviewed the annexation petition for compliance with Section 31- 12- 107(1) of the Colorado Revised Statutes and recommends that City Council approve the Resolution. BACKGROUND The Bluffs Annexation, Phase 1 submitted by Bluffs on the Boulevard, LLC is comprised of 8.60 acres west of the intersection of Pueblo Blvd and West 29"' Street and east of Pueblo Motorsports Park. The purpose of the annexation is to provide a location for a future commercial planned unit development. This Resolution determines that the Petition for Annexation is found and determined to be in substantial compliance with the provisions of the Colorado Revised Statutes 31 -12- 107(1). A public hearing is scheduled for April 14, 2008 to determine if the area proposed to be annexed meets the applicable requirements of C.R.S. 31 -12 -104 and 31 -12 -105 to establish eligibility for annexation under the Municipal Annexation Act of 1965. It also directs the City Clerk to publish notice of public hearing once a week for four successive weeks in the Pueblo Chieftain. By approving the attached resolution City Council finds the annexation petition is in substantial compliance with state annexation statutes and sets the date of April 14, 2008 for a public hearing. The date for the first presentation of the Ordinance for Annexation is scheduled for March 24, 2008. FINANCIAL IMPACT The filing of the annexation petition and this Finding of Substantial Compliance does not result in any direct financial impact to the City of Pueblo.
