HomeMy WebLinkAbout11198RESOLUTION NO. 11198 A RESOLUTION ADOPTING AN INCREASED FEE SCHEDULE FOR LIQUOR AND BEER LICENSE APPLICATIONS AND PERMITS AND REPEALING RESOLUTION NO. 8272 WHEREAS, the fees charged for liquor and beer licenses, applications and permits are set by state law; and WHEREAS, the Colorado legislature has increased such fees in 2007; and WHEREAS, action by the City Council is necessary in order to increase the local fees which may be charged for processing of applications; and WHEREAS, the Council finds and determines that an increase in fees is appropriate to cover the actual and necessary expenses of processing such applications; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Local fees chargeable for liquor and fermented malt beverage license applications and permits are adopted as herein set forth. (a) For a new license, the application fee shall be as follows: (1) For application received on or before July 1, 2008, the application fee shall be six hundred and twenty -five dollars ($625.00). (2) For application received after July 1, 2008 and before July 2, 2009, the application fee shall be seven hundred and fifty dollars ($750.00). (3) For application received after July 1, 2009 and before July 2, 2010, the application fee shall be eight hundred and fifty dollars ($850.00). (4) For applications received after July 1, 2010, the application fee shall be one thousand dollars ($1,000.00). (b) For a transfer of location or ownership, the application fee shall be as follows: (1) For application received on or before July 1, 2008, the application fee shall be six hundred and twenty -five dollars ($625.00). (2) For application received after July 1, 2008 the application fee shall be seven hundred and fifty - dollars ($750.00). (c) For a timely renewal application, i.e. an application filed on or prior to the expiration date of the existing license, the application fee shall be as follows: (1) For application received on or before July 1, 2008, the application fee shall be seventy -five dollars ($75.00). (2) For application received after July 1, 2008, the application fee shall be one hundred dollars ($100.00). (d) For a late renewal application, i.e. an application received after but not more than ninety (90) days from and including the expiration date of the existing license, the application fee shall be five hundred dollars ($500.00). (e) For a temporary permit application under §12 -47 -303, C.R.S., the application fee shall be one hundred dollars ($100.00). (f) For a manager registration with respect to a hotel and restaurant liquor license under §12 -47 -411, C.R.S., the registration fee shall be seventy -five dollars ($75.00). (g) For a manager registration with respect to a Tavern liquor license under §12 -47- 412, C.R.S., the registration fee shall be seventy -five dollars ($75.00). (h) For qualification of officers, directors, stockholders, members or managers of corporation or limited liability company applicants, a fee of one hundred dollars ($100.00) for fingerprint analysis and background investigation shall be paid unless the applicant has already undergone a background investigation by and paid a fee to the state licensing authority. SECTION 2. Resolution No. 8272 is hereby repealed. SECTION 3. This resolution shall become effective thirty (30) days after final passage and approval. RECOMMENDATION Staff and the Pueblo Liquor and Beer Licensing Board recommend adoption of the Resolution. BACKGROUND The Colorado Municipal Clerk's Association, with the assistance of the Colorado Municipal League, created a Legislative Task Force to research and review the actual costs for a municipality to process liquor and beer license applications. A proposal concerning an increase in the amount of fees local jurisdictions are permitted to charge for alcohol beverage related applications was then presented to the State Legislators. In response to the proposal, the General Assembly of the State of Colorado enacted Senate Bill 97 -149, which increased the maximum fees that a local licensing body may charge for new licenses, renewals and transfer of ownership or location. The proposed Resolution incorporates these increased fees and restates all other fees that are assessed with respect to such matters. It is anticipated that the proposed application fee increases will cover the actual costs for processing the beer and liquor license applications.
