HomeMy WebLinkAbout11178RESOLUTION NO. 11178 A RESOLUTION APPROVING AMENDMENT NO. 1 TO THE FEBRUARY 13, 2006 COOPERATION AGREEMENT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE HARP FOUNDATION, A COLORADO NONPROFIT CORPORATION, RELATING TO THE FUNDING OF THE HISTORIC ARKANSAS RIVERWALK OF PUEBLO — PHASE III A -1 PROJECT AND AUTHORIZING THE PRESIDENT OF THE COUNCIL TO EXECUTE SAME BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 _ Amendment No. 1 to the February 13, 2006 Cooperation Agreement, between the City and HARP Foundation, relating to the funding for construction of the HARP Phase IIIA -1 Project, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The President of the City Council is hereby authorized to execute and deliver the Amendment No. 1 on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest same. RECOMMENDATION Approval of the Resolution. BACKGROUND On February 13, 2006 the City and the HARP Foundation entered into a Cooperation Agreement outlining the funding requirements for the construction of the HARP Phase ILIA -1 project. During the construction process over the past year, the funding sources have changed through fund raising efforts by the HARP Foundation. This Amendment No. 1 identifies those funding changes. FINANCIAL IMPACT There is no financial impact to the City of Pueblo. AMENDMENT NO. 1 THIS AMENDMENT NO. 1 to the February 13, 2006 Cooperation Agreement, between Pueblo, a Municipal Corporation ( "City") and the HARP Foundation, a Colorado nonprofit corporation ( "Foundation") for the construction of Phase IIIA -1 of the Historic Arkansas Riverwalk of Pueblo Project ( "Agreement "), WITNESSETH: WHEREAS, the City and the HARP Foundation desire to amend the "Agreement" NOW, THEREFORE, in consideration of the mutual covenants contained herein, the City and Foundation agree as follows: A. Paragraph No. 4 of the Agreement is amended to read as follows: 4. City and Foundation agree that the funding for construction of the Project is as follows: Economic Development Administration (EDA) $1,000,000 Department of Local Affairs to the City 900,000 Great Outdoors Colorado to the City 500,000 HARP Foundation 750,568 HUD Special Projects Grant 118,800 HARP Foundation (through a donation by the BOWW) 77,000 Pueblo Urban Renewal Authority 50,000 Total Cost $3,396,368 B. Paragraph No. 12 of the Agreement is amended to read as follows: 12. The Foundation has secured and made available or will make available the following in -kind contributions for the construction of the project: Aquila $100,000 GCC/LaFarge 70,000 Beltramo and Sons 45,200 T &T Electric 10,000 C &C Sand and Stone 5,500 Summit Brick and Tile 20,000 Haddonstone 2,000 Southside Landscaping 13,000 GS Masonry 2,000 ML Strasia & Sons 10,000 Montano Concrete 2,500 Total Value of In -Kind Contributions $280,200 Executed at Pueblo, Colorado, as of December 31, 2007.
