HomeMy WebLinkAbout11151RESOLUTION NO. 11151 A RESOLUTION AUTHORIZING THE ISSUANCE OF A BUILDING PERMIT PRIOR TO THE RECORDING OF THE NORTH PUEBLO COMMERCIAL PARK SUBDIVISION, FILING NO. 1, 1S AMENDMENT FOR THE LAND TO BE OCCUPIED BY A HOLIDAY INN & SUITES HOTEL LOCATED ALONG NORTH DILLON DRIVE BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Due to exigent circumstances, contemporaneously with the filing of a complete subdivision application meeting all of the requirements of Chapter 4, Title XII of the Pueblo Municipal Code as determined by the Director of Public Works ( "Subdivision ") for Lot 1, North Pueblo Commercial Park, Filing No. 1, 1S Amendment Subdivision, the Holiday Inn & Suites Hotel, located along north Dillon Drive ( "Property "), the City administration is authorized to approve the issuance of a building permit for a building or structure to be constructed or installed on the Property ( "Building Permit "). SECTION 2. The Building Permit will be deemed revoked and cancelled if the owner of the Property does not diligently pursue the Subdivision to final approval. No certificate of occupancy shall be issued for any building or structure constructed or installed on the Property pursuant to the Building Permit until after the Subdivision has been approved by City Council. The conditions, restrictions, and limitations set forth herein shall be incorporated in and made a part of the Building Permit. TITLE A RESOLUTION AUTHORIZING THE ISSUANCE OF A BUILDING PERMIT PRIOR TO THE RECORDING OF THE NORTH PUEBLO COMMERCIAL PARK SUBDIVISION, FILING NO. 1, 1 1T AMENDMENT FOR THE LAND TO BE OCCUPIED BY A HOLIDAY INN & SUITES HOTEL LOCATED ALONG NORTH DILLON DRIVE ISSUE Should the City Council authorize the issuance of a building permit prior to the recording of the North Pueblo Commercial Park, Filing No. 1, 1" Amendment Subdivision. RECOMMENDATION Approval of this Resolution. BACKGROUND The subject property has recently undergone the re- subdivision process, and Ordinance No. 7613 approving a revised subdivision was passed on June 25, 2007. Since then, the developer, Pueblo Lodging, LLC, has modified the plat such that the subdivision approval process had to be repeated. In an effort to allow construction of the Holiday Inn & Suites hotel to proceed, a request was been made by the developer for the City to sign off on a building permit prior to a recorded resubdivision. On October 9, 2007, City Council approved a resolution authorizing City administration to approve the issuance of a "FOUNDATION ONLY" building permit prior to the recording of the subdivision plat. At this time, construction has progressed as such that the builder is ready to move further past the foundation portion of the building. The City has no objection to the issuance of a full building permit; however, the building permit will be revoked and cancelled if the owner of the property does not diligently pursue the completion of the subdivision process. No certificate of occupancy shall be issued for any building or structure associated or installed on the property until after the subdivision has been approved by City Council. FINANCIAL IMPACT None.
