RELATING TO THE BUILDING LOCATED AT 3255X2 NUCKOLLS AVENUE, PUEBLO, COLORADO BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Lease Extension Agreement dated as of November 12, 2007 between Pueblo Municipal Shooters, Inc. as Tenant and the City of Pueblo, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The President of the City Council is hereby authorized to execute and deliver the Lease in the name of the City of Pueblo and the City Clerk is directed to affix the seal of the City thereto and attest same. RELATING TO THE BUILDING LOCATED AT 3255% NUCKOLLS AVENUE, PUEBLO, COLORADO ISSUE Should the City Council approve the Lease Extension Agreement between the City of Pueblo and Pueblo Municipal Shooters, Inc. be approved for an additional five years? BACKGROUND Pueblo Municipal Shooters, Inc. has used the building located at 3455'/2 Nuckolls Avenue, located in the City Park, since 1957. The City of Pueblo owns the land on which the Shooters building is located. The proposed lease extension agreement would allow the organization to continue operating from that same location for an additional five -year period. Concerns had been raised regarding health issues of the users of the facility. The Municipal Shooters contacted the firm of Acclaim Environmental Services for technical assistance to resolve the concerns. After reviewing the recommendations, the Pueblo City - County Health Department concurred and indicated that they were willing to do some training of the organization's instructors to reduce personal exposures. RECOMMENDATION Approval of the Resolution. FINANCIAL IMPACT There is no financial impact to the City LEASE EXTENSION AGREEMENT THIS LEASE EXTENSION AGREEMENT entered into as of November 12 , 2007 by and between Pueblo, a municipal corporation ( "Landlord ") and Pueblo Municipal Shooters, Inc. ( "Tenant'), WITNESSETH: WHEREAS, Landlord and Tenant entered into a Lease dated December 1, 2002 for the land commonly known as 3455 Nuckolls, Avenue, Pueblo, Colorado, 81005 ( "Lease "), and WHEREAS, Landlord and Tenant desire to extend the term of the Lease. NOW, THEREFORE, in consideration of the foregoing and mutual covenants contained herein, Landlord and Tenant agree as follows: 1. The Term of the Lease is extended for an additional five (5) years, commencing December 1, 2007 and ending November 30, 2012, both dates inclusive, unless sooner terminated as provided in the Lease. 2. The Lease as extended hereby shall be binding upon and inure to the benefit of Landlord and Tenant and their respective successors and approved assigns. Executed the day and year first above written.
