HomeMy WebLinkAbout11122RESOLUTION NO. 11122 A RESOLUTION APPROVING SUPPLEMENTAL AGREEMENT NO. 2 TO THE LEASE AGREEMENT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE UNITED STATES OF AMERICA AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME WHEREAS, the City of Pueblo, a Municipal Corporation, and the United States of America entered into a Lease Agreement on May 24, 2004 relating to the lease of office and related space in the terminal building at the Pueblo Memorial Airport; and WHEREAS, both parties wish to amend the provisions of the Lease Agreement as set forth in Supplemental Agreement No. 2; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 _ A certain Supplemental Agreement No. 2, a copy of which is attached hereto and made a part hereof by reference, after having been approved as to form by the City Attorney, by and between the City of Pueblo, a Municipal Corporation, and the United States of America relating to the lease of office and related space at the Pueblo Memorial Airport, is hereby approved, subject to the conditions as set forth in said Supplemental Agreement No. 2. SECTION 2. The President of City Council is hereby authorized to execute said Supplemental Agreement No. 2 on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the Seal of the City thereto and attest the same. RECOMMENDATION Approval of this Resolution. BACKGROUND City Council approved a Lease Agreement between the City and the United States of America on May 24, 2004 for 610 square feet of office and related space in the terminal building at the Pueblo Memorial Airport. The lease space is for the use of the Transportation Security Administration (TSA) screeners. The Supplemental Agreement is to amend the lease to include an additional 18 square feet of space in the terminal building. All other terms and conditions of the lease will remain unchanged. FINANCIAL IMPACT The lease is currently for 610 square feet at $16.50 per square foot per year for a total of $10,065 annually. The additional 18 square feet will increase the rent $297 per year for a total of $10,362 annually. GENERAL SERVICES ADMINISTRATION SUPPLEMENTAL AGREEMENT NO.2 DATE: September 7, 2007 PUBLIC BUILDINGS SERVICE SUPPLEMENTAL LEASE AGREEMENT TO LEASE NO. GS -08P- 13975 ADDRESS OF PREMISES City of Pueblo, 31201 Bryan Circle, Pueblo, CO 81001 THIS AGREEMENT, made and entered into this date by and between: Pueblo Memorial Airport whose address is 31201 Bryan Circle Pueblo, CO 81001 hereinafter called the Lessor, and the UNITED STATES OF AMERICA, hereinafter called the Government: WHEREAS, the parties hereto desire to amend the above Lease to include an additional 18 rsf of space. NOW THEREFORE, these parties for the considerations hereinafter mentioned covenant and agree that the said Lease is amended, effective December 1, 2007 as follows: In reference to the Lease Agreement. The paragraph indicating the rentable square footage is amended to include an additional 18 rsf for a total of approximately 628 rentable square feet of office and related space in the Terminal Building.. This additional square footage will yield a new annual rental cost of: 628 rsf x $16.50 = $10,362.00 This amendment to the lease may be terminated by either party with thirty (30) days written notice. The Government understands that use of the Office is non - exclusive and contingent upon the needs of the Airport. All other terms and conditions of the leasha emain in force and effect.
